<br />4. Compliance with Rehabilitation Act <br /> <br />To the extent it is required and not otherwise exempt by <br />applicable law, under Section 504 of the Rehabilitation Act (24 CFR <br />~ 8.22) five percent (5%) of the units, or one (1) unit, shall be <br />mobility accessible; and, an additional two percent (2%) of the <br />units, or one (1) unit shall be designated as a sight and hearing <br />unit. If Participant makes a good faith determination that these <br />improvements cannot be feasibly completed, Participant shall comply <br />with 24 CFR ~8.23(b) to make ureasonable accommodations", as such <br />term is defined in ~504 of the Rehabilitation Act. <br /> <br />5. Lead-Based Paint <br /> <br />The use of lead-based paint is prohibited on residential <br />property. As such, this Project is required to test for lead-based <br />paint under Federal law. Title X of the Housing and Community <br />Development Act of 1992, which appears within Title 24 CFR Part 35 <br />sets forth the requirements concerning lead-based paint in <br />federally associated housing. All projects built before 1978 which <br />receive federal assistance for rehabilitation require a Lead-Based <br />Paint Inspection and Risk Assessment by an ADHS Certified Inspector <br />with random testing, to include all painted surface components, <br />dust wipe samples and soil samples. Stabilization and/or abatement <br />shall be conducted by DHS certified contractors and qualified <br />workers prescribed by law. <br /> <br />6. Tenant Participation plan <br /> <br />To the extent 24 CFR 92.303 applies to Participant, <br />Participant must adhere to a fair lease and grievance procedure <br />approved by the City and must provide a plan for, and follow, a <br />program of tenant participation in management decisions. Said <br />plan, if required, must be submitted to the City as a condition for <br />the issuance of the Certificate of Completion for the Project. <br /> <br />7. Reporting Requirements <br /> <br />Participant shall submit the following reports as <br /> <br />follows: <br /> <br />1) Direct Benefit Report. When the Project is <br />completed, as evidenced by the issuance of the <br />Certificate of Completion, and is available for rent by <br />qualified tenants, Participant shall submit a Direct <br />Benefit Report, in substantially the same form as <br />attached to this Scope of Development as Attachment No. <br /> <br />EXHIBIT ~B"- PAGE 3 <br />
