'.:' ..... . <br /> <br /> <br />. . <br />. ..' . <br />. . . .' . <br /> <br />'~~~ <br /> <br />July 27,2009 <br /> <br />SUBJECT <br />Emergency Generator Retrofit at Police Facility <br /> <br />RECOMMENDATION <br />1) Authorize, by resolution, amendment of the Fiscal Year 2009/2010 Capital <br />Improvement Program to approve and provide appropriation in the amount of <br />$65,000.00 for immediate work to retrofit the emergency generator at the' Police <br />F acUity . <br />2) Suspend, by motion, the bidding and purchasing requirements of Chapter 2, Article <br />VII of the Municipal Code to anow agreement with Cummins West for the work to <br />retrofit the emergency generator in the amount of $37,343.70, and TEC Accutite for <br />the work to decommission, remove, and dispose of the existing underground fuel <br />tank in the amount of $15,750.00 based on the facts and findings set forth in this <br />staff report. <br />3) Approve, by motion, agreements with Cummins West in the amount of $37,343.70, <br />and TEC Accutite in the amount of $15,750.00 and authorize the City Manager to <br />execute the agreements and increase the agreement amount, if necessary, up to <br />100/0. <br /> <br />BACKGROUND <br />The underground fuel storage tank that serves the emergency generator at the Police <br />Facility and Emergency Operation Center (EOC) was recently evaluated for leakage. <br />Inspection by both the original tank manufacturer (Containment Solutions, formerly <br />Corning Owens) and TEe Accutite, an environmental engineering contractor, revealed a <br />large fracture in the tank. The required repair is costly and without guarantee. <br /> <br />Rather than repair the existing underground tank, staff believes a much more reliable <br />solution is to install a new aboveground fuel storage tank ("belly tank") to supply the <br />emergency generator. As part of this installation, an emergency plug and a transfer <br />switch would also be installed to provide a connection point for other portable <br />emergency generators so that this essential facility is not dependent on a sole source <br />for emergency electrical power. The existing underground tank would be removed and <br />disposed of. <br /> <br />Staff requests that Council find to suspend the bidding and purchasing requirements of <br />Chapter 2, Article VII of the Municipal Code to allow expeditious agreement with both <br />Cummins West and TEC Accutite as proscribed in Section 2.76. <br />Sec. 2.76. GROUNDS AND PROCEDURE FOR SUSPENSION OF ARTICLE <br />REQUIREMENTS: <br />The requirements of this Article relating to the purchase of materials, equipment and <br />supplies may be suspended by motion of the City Council in any case where the <br />Council finds that strict compliance would not seNe the public interest, including, but <br />not limited to, instances where the only material, equipment or supplies that are <br />
