<br />REPORT <br /> <br />7A <br />age 1 <br /> <br />To the Honorable May.or and City Council <br />From the Ci Manaer <br /> <br />July 27,2009 <br /> <br />SUBJECT <br />Appeal of the Zoning Administrator's Approval of a Use Permit for a massage service <br />establishment. <br /> <br />RECOMMENDATION <br />Deny the appeal by Motion, thereby upholding the decision of the Zoning Administrator, <br />with revised conditions of approval based on the findings as documented in the Notice <br />of Official Action (Attachment 1), to allow a massage service establishment at 515 <br />Woodside Road. <br /> <br />BACKGROUND <br />Per the direction provided by the City Council at the July 13, 2009 public hearing <br />regarding the appeal of the Zoning Administrator's approval of the Use Permit for the <br />massage establishment, staff has prepared a revised Notice of Official Action with the <br />following modifications (Attachment 2): <br /> <br />. Revised Condition 13 as follows: The hours of operation for the business shall be <br />from 10:00AM-6:00PM, Monday-Friday, 10:00AM-4:00PM on Saturday and Sunday. <br />(Note: The hours of operation in the original Notice of Official Action were as follows: <br />1 0:00AM-8:00PM, seven days a week). <br /> <br />. Use Permit Validity: The Use Permit shall expire after 24 months from the date of <br />Council action. The applicant may re-apply for a new Use Permit, provided that the <br />business and its owner/operator and employees are in good standing with the City. <br /> <br />Hours of Operation: With respect to limiting hours of operation for this use, Council <br />could consider the approved hours of operation for similar businesses within City limits <br />as shown below. The context with respect to proximity of these businesses to <br />residential development is provided as well. <br /> <br />
