Redgwick <br /> alleged that the apparent low bid submitted by Pa�ex was "unbalanced", which means <br /> that some of the unit price items are substantially undenraiued, whi[e other items are <br /> overvalued. Redgwick specified two line items, aggregate base and hot mix asphalt, <br /> and asser�ed that the imbalance would affect the city's overall cost for the project. <br /> Pavex responded fio the protest in a letter dated July 20, 2009. (n that fetter, Pavex <br /> acknowledged the city's discretion to reject unbalanced bids. Pa�ex attributed the Iow <br /> unit prices to the �act that it is an integrated materiai supply, transpor�ation, and <br /> construction campany. <br /> AL.TERNATIVES <br /> Council may choose to reject the apparent low bid submitted by Pa�ex and award the <br /> contract to Redgwick as the secand iowest bidder. Any legal chalienge by either Pavex <br /> or Redgwick may delay the work of this project, <br /> FISCAL IMPACT <br /> A total of $1,162,000.0� in ARRA and CMAQ grant funds have been awarded <br /> specifically for the streetscape work of this praject.
