The Applicatio�. requests the following Iand �zse <br /> entitlements necessary for the Proj ec#: a general plan amendment, a rezoni.ng, a specific plan, <br /> and a development agreement(the"Proj ect Entitlemen�s"}. <br /> C. The Ci.ty i.s required under the Cali�'o��aia Environmental Quali.ty Act {Public <br /> Resources Cvd.e § 21000 et seq.} to prepare and certify, prior to any approval of �he Project <br /> Entitlements, an en�ironmental impact repor� that assesses the potenti.a]. envi.ronm.ental impacts <br /> of:, and alte.rn.ativcs to,th.e Proj ect�the"EIR"}. <br /> D. City has requested Developer, and Developer agrees as set forth herein, to fund <br /> the fees and costs of specia� lega� caun.sel. ta be retazned by C�.ty to assist the City in zts <br /> preparation of the E�and evaluation of thc Proj ect Entitlements. <br /> AGREElVIENT <br /> ARTICLE 1. EFFECT.iVE DATE AND TER� <br /> Section l.�l. Ef.f.ective Date. This Agreement becomes effective on the date this <br /> Agreement is ful.ly execuied by i:lie Parties(the "Ef..fective Date"). <br /> Secl:ion 1.�2. Term.
