Approve the recommended responses to the Grand Jury Report <br />2. Authorize the Mayor to send these responses to the Presiding Judge of the Civil <br />Grand Jury. <br /> <br />BACKGROUND <br />On July 10, 2009 the San Mateo County Civil Grand Jury issued a report titled <br />"TRASHT ALK: Rethinking the Waste Management RFP Process by the South Bayside <br />Waste Management Authority." This Report contained a series of findings and <br />recommendations in connection with the contractor selection processes managed by <br />the South Bayside Waste Management Authority (SBWMA) on behalf of member <br />agencies which resulted in the recommended selection of Recology (formerly known as <br />Norcal Waste) to provide solid waste and recycling collection services and South Bay <br />Recycling (SBR) to operate the Shoreway Recycling and Disposal Facility (SRDC). <br /> <br />The SBWMA is a joint powers authority, of which the City is a member, which consists <br />of 12 government agencies in the south county region whose purposes include owning <br />the SROC and assisting member agencies with solid waste management issues <br />including managing portions of the solid waste and recycling collection franchise <br />agreements entered into by each member agency. Currently, each of the member <br />agencies holds a franchise agreement with Allied Waste for collection services which <br />expires on December 31, 2010 while the SBWMA holds an agreement with Allied Waste <br />for the operation of the SRDC which also expires on December 31, 2010. <br /> <br />Grand Jury Report <br />In September 2008 the San Mateo County Civil Grand Jury began investigating the <br />contractor selection process undertaken by the SBWMA in response to complaints <br />about the nature of the process. It is important to note that such complaints surfaced <br />only after the SBWMA Board of Directors recommended that each member entity select <br />Recology as their franchised solid waste and recycling collection contractor and short- <br />listed Hudson-Baylor and SBR as the two finalists to be considered for the contract to <br />operate the SRDC. <br /> <br />The Grand Jury issued their Report (Attachment One) on July 10, 2009. The SBWMA <br />Board has reviewed this Report at their July 23 Board meeting and approved a <br />response to this Report. This response is attached - see Attachment Two. <br /> <br />Since the Grand Jury Report was addressed not only to the SBWMA but to member <br />agencies as well, State law requires that each member agency issue their response in <br />addition to the SBWMA's response. <br />
