<br />1 <br />2 Attachment 10 <br />3 Liquidated Damages <br />4 <br /> <br />5 The following table lists the events that constitute breaches of the Agreement's standard of <br />6 performance warranting the imposition of Liquidated Damages. The table describes the incident <br />7 or event(s) that trigger Liquated Damages, the method by which occurrences will principally be <br />8 tracked by Contractor or Authority, and the dollar amount of Liquidated Damages for failure to <br />9 meet the contractually-required performance. <br /> <br />10 Authority may require the Liquidated Damages to be paid concurrently with submission of each <br />11 quarterly report or factor the payment of the Liquidated Damages in establishing Contractor's <br />12 compensation for the following Rate Year. <br /> <br />13 Authority intends to suspend imposition of Liquidated Damages for the initial. six months of <br />14 Operations Agreement, provided that Contractor diligently appljes its best efforts to minimize the <br />15 occurrence of events which can result in the imposition of Liquidated Damages. If Contractor <br />16 does not exert such best efforts, Authority may, after notice to Contractor, end this policy and <br />17 begin enforcement of the performance standards through Liquidated Damages. <br /> <br />SBWMA Facility Operations Agreement, Attachment 10 <br />Liquidated Damages <br />Page 1 of 3 <br />
