<br />1 <br />2 The reduction in operational personnel should approximate the percentage reduction in <br />3 tonnage. <br />4 <br />5 Employees classified as Management and Administration may not be reduced below <br />6 the number shown on Attachment 9. <br />7 <br />8 A reduction in personnel permitted by this subsection will not increase or decrease the <br />9 cost per Ton otherwise established pursuant to Sections 7.03 and 7.04. Nor will it affect <br />10 the Revenue Guarantee established in Section 7.07. <br />11 <br />12 Such a reduction in operational personnel shall not change the Contractor's obligations <br />13 to perform under this Agreement. <br />14 <br /> <br />15 5.12 WEIGHING <br /> <br />16 A. Contractor shall operate and maintain the scale system at the Shoreway Center. <br />17 Weighing operations shall be conducted in accordance 'With standards and procedures <br />18 set forth in Attachment 3. <br /> <br />19 B. Contractor shall furnish all hardware (including computers, cabling and terminals), <br />20 software, and all other items necessary to generate, at a minimum, all the reports <br />21 contained in Attachment 15. The software shall have the capabilities described in <br />22 Attachment 3. Contractor shall obtain the Authority's prior written approval of the <br />23 specific hardware and software proposed to be furnished and used by the Contractor <br />24 pursuant to this paragraph. <br /> <br />25 C. Contractor shall provide the Authority with licenses, documentation and training <br />26 necessary or useful for the Authority to operate the computers and software during and <br />27 upon expiration or earlier termination of the Agreement. <br /> <br />28 D. Radiation monitoring equipment is used at the entrance to the Shoreway Center to <br />29 identify loads containing radioactive waste. Contractor shall operate the equipment and <br />30 respond to alerts by contacting the Authority and local regulatory agencies as required <br />31 by law. <br /> <br />32 5.13 COLLECTION OF FEES <br /> <br />33 The Authority has the sole and exclusive authority to establish rates and fees charged to <br />34 users of the Shoreway Center and to modify them from time to time. Contractor shall collect <br />35 fees established by the Authority from all Self-Haul Customers who use the Shoreway <br />36 Center. Contractor shall keep complete and accurate records of all fees collected, shall <br />37 keep safe all monies and funds collected, and shall make all payments to the Authority as <br />38 provided in Section 8.04. <br /> <br />39 5.14 VEHICLE TURNAROUND GUARANTEE <br /> <br />40 Contractor shall operate the Shoreway Center so that: <br /> <br />41 A. Collection vehicles of Member Agencies and their Collection Contractor(s) are: <br /> <br />42 1. processed through the scale house operation in no more than five (5) minutes per <br />43 vehicle, measured from the vehicle's entry into the scale house vehicle queue, and <br /> <br />Operating Agreement for Shoreway Center <br /> <br />Page - 17 - <br /> <br />7/30/09 <br />
