6.H. - Page 2 of 35 <br />floor area ratio, and allow all existing short-term rentals in ADUs constructed prior to January 1, 2020 <br />and prohibit any new short-term rentals in all other ADUs. <br />At the March 8, 2021 hearing, the City Council revised the draft ordinance to allow a maximum 20 foot <br />height for attached ADUs encroaching within the rear setback area and for detached ADUs. The ordinance <br />as introduced would allow both standalone two-story detached ADUs and second -story ADUs above a <br />detached garage. In order to capture the intent of the extensive discussions by the City Council over the <br />past few years regarding balancing the need for housing with privacy interests, the draft ordinance retains <br />existing sections of the 2019 ADU Ordinance update related to privacy regulations for second story <br />detached ADUs including standards for balconies, exterior stairways, and windows. The draft ordinance <br />does not retain a second story square footage maximum of 576 square feet above a garage as the final <br />motion at the March 8, 2021 hearing was simplified to only require a 20 -foot maximum height and ADU <br />law no longer requires construction above a garage. <br />The following sections of the City's existing Zoning Ordinance are retained in the draft ordinance as they <br />would address massing and privacy impacts from detached second story ADUs, as set forth in Section <br />37.3(C)(3)(b)(ii)-(iv), with no new edits: <br />• Balconies and second story decks shall be prohibited. <br />• Open stairways shall be located interior to the site and not facing the immediately adjacent side <br />or rear yards. <br />• Second story plate height shall be limited to eight (8) feet. <br />• Windows facing immediately adjacent side and rear neighbors shall be made opaque or <br />clerestory. <br />The impact of retaining these privacy regulations is minimal and would not significantly impact the <br />construction of an ADU. The draft Ordinance also updates the definition of Junior Accessory Dwelling Unit <br />(JADU) and clarifies that JADUs "shall" require a kitchen or efficiency kitchen instead of "may" require a <br />kitchen; both of these changes are consistent with the State's requirements. Other miscellaneous changes <br />include updating the proper job title for the Community Development and Transportation Director and <br />removing pronoun language. <br />A document showing these revisions when compared to the draft ordinance is included with this report <br />(Attachment C).
