PROJECT UNDERSTANDING AND "NEW" EIR APPROACH <br /> <br />1.1 BACKGROUND AND OBJECTIVES <br /> <br />In February 2007, the City of Redwood City City Council took actions constituting approval of a <br />Downtown Precise Plan, including: <br /> <br />· certification of a final Environmental Impact Report (EIR); <br /> <br />· adoption of a Downtown Precise Plan (DPP) by Ordinance No. 2308; and <br /> <br />· amendment of the City's Zoning Map by Ordinance No. 1130-338 to rezone properties in the <br />DPP Area. <br /> <br />Subsequently, the February 2007 DPP approval, including the EIR certification, DPP adoption <br />and Zoning Map amendment, was litigated in San Mateo County Superior Court and on <br />February 11, 2009, the Court entered a final judgment and issued a peremptory writ of mandate <br />ordering the City to set aside the DPP approvals including the final EIR certification, DPP <br />adoption (Ordinance No. 2308) and Zoning Map amendment (Ordinance No. 1130-338). The <br />Court judgment identified three primary deficiencies in the 2007 EIR: <br /> <br />· the Court found that the 2007 EIR did not adequately address the potential shadow <br />impacts on adjacent properties of DPP-permitted taller buildings; <br /> <br />· the Court found that the 2007 EIR did not adequately address the protection of historic <br />resources, including historic structures, in the Downtown; and <br /> <br />· the Court found that the 2007 EIR did not adequately address the possibility of one or more <br />alternative sites for the project. <br /> <br />While respectfully disagreeing with the Court's ruling, in the interest of meeting its original <br />objective to adopt a new DPP at the earliest possible time, the City Council took action in March <br />2009 to set aside the 2007 EIR certification, DPP adoption (Ordinance No. 2308) and Zoning <br />Map amendment (Ordinance No. 1130-338). The action was taken to permit the City to focus <br />on completion of a new DPP and DPP programmatic EIR, and the new General Plan and <br />programmatic new General Plan EIR, as soon as possible. <br /> <br />1.2 PROPOSED NEW DPP EIR PREPARATION OBJECTIVES AND APPROACH <br /> <br />This proposal describes our proposed scope of services, schedule and budget for completion of <br />a "new" Environmental Impact Report (new EIR) for the new Downtown Precise Plan (new <br />DPP).
