7.A. - Page 3 of 53 <br />This size requirement was developed to allow an ADU above a typical 24 ft. x 24 ft. two -car garage, and <br />as noted, two-story ADUs are no longer required above garages, likely negating the need for this specific <br />second story square footage restriction. In addition, the 8 ft. plate height limit to second stories is no <br />longer necessary, as the maximum height for detached ADUs is limited to 20 ft. and this floor height limit <br />is therefore no longer compatible. Striking both of these 2019 requirements affords more flexibility for <br />ADU designs. <br />2. Retain the remaining 2019 ADU Ordinance privacy standards. These privacy standards should be <br />included to address the neighborhood concerns that have been raised during the past two years. These <br />standards include the following: <br />• Prohibit balconies and second story decks <br />• Prohibit open stairways facing immediately adjacent side and rear neighbors <br />• Require opaque or clerestory windows when facing immediately adjacent side and rear <br />neighbors. <br />To provide options for the City Council's deliberation there are three ordinances attached to this staff <br />report. <br />• Attachment A is the ordinance recommended by staff (described above). <br />• Attachment B is a draft ordinance that includes all 2019 massing and privacy regulations, setting <br />a 576 square footage limitation "above the ground floor" rather than above a garage. This is <br />because detached ADUs are no longer limited to placement above a garage. This ordinance <br />implements Alternative 1 below. <br />• Attachment C is a draft ordinance that removes all of the 2019 massing and privacy regulations. <br />This ordinance implements Alternative 2 below. <br />FISCAL IMPACT <br />None <br />ENVIRONMENTAL REVIEW <br />Multiple CEQA provisions apply to the proposed ordinance. The adoption of an ordinance to implement <br />State law pertaining to ADUs (Government Code section 65852.2) is a statutory exemption from the <br />California Environmental Quality Act (CEQA) pursuant to Public Resources Code section 21080.17. This <br />applies to State law requirements that would be implemented by the proposed ordinance including the <br />number of ADUs allowed, junior ADUs, ADUs in multifamily structures, setbacks, maximum allowable <br />square footage, and providing for certain "streamlined" ADUs, all as specified in the linked staff reports. <br />In addition to implementing State law requirements, the proposed ADU ordinance would implement local <br />requirements.
