6.F. - Page 4 of 6 <br />ANALYSIS <br />Authority <br />The City Council has the authority to amend the Affordable Housing Ordinance and Affordable Housing <br />Impact Fee Resolution for further clarity, update allowable fees, and enact a local live/work preference <br />policy so long as the policy conforms to State and Federal regulations. <br />The City Council also has authority to amend the Park Impact Fee and the Park in Lieu Fee, and adopt a <br />new Commercial Park Impact Fee. <br />Applicability <br />There are generally two types of development applications: (1) applications that are regulated under local <br />and state law; or (2) applications that are only regulated under local law (Use Permit, Planned Community <br />Permit, etc.) <br />Development applications that are regulated under both local and state law (i.e. containing a subdivision <br />map per the State Subdivision Map Act) are generally only required to follow policies that are in effect on <br />the date that the application is found to be complete (Government Code Section 66474.2(a)). However, if <br />the City Council chooses to initiate proceedings to (1) amend the Affordable Housing Ordinance, <br />Affordable Housing Impact Fee, and implementing resolutions, policies and standards; (2) amend the <br />Parks Impact Fee Ordinance, Residential Development Park Impact Fee, Quimby Act Implementation <br />Ordinance, and Park in Lieu Fee; and (3) introduce a new Commercial Park Impact Fee (such as by motion) <br />and then publishes notice of the City Council's action in a newspaper of general circulation, any such <br />requirement will apply to subdivisions found to be complete after the notice is published, so long as the <br />subdivisions are approved after the requirement is in effect (Government Code Section 66474.2(b)). <br />Therefore, if the City Council makes the motion associated with this report and initiates proceedings to <br />consider the aforementioned amendments, incomplete and new map applications will be subject to any <br />future requirement. <br />For development applications that are only regulated under local law (no subdivision map), the City may, <br />in some cases, apply the requirement to pending and complete applications. <br />Timing <br />Staff expects that the City Council will consider amendments to (1) the Affordable Housing Ordinance, <br />Affordable Housing Impact Fee, and implementing resolutions, policies and standards, (2) the Parks <br />Impact Fee Ordinance, Residential Development Park Impact Fee, Quimby Act Implementation Ordinance, <br />and Park in Lieu Fee, and (3) introduction of a new Commercial Park Impact Fee, in late summer or early <br />fall of 2021.
