6.M. - Page 5 of 22 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY ADOPTING LOCAL STANDARDS AND PROCEDURES FOR THE OPERATION OF THE TWO YEAR TEMPORARY RECREATIONAL VEHICLE SAFE PARKING PROGRAM WHEREAS, the City of Redwood City has undertaken multiple efforts at the local level to combat homelessness; and WHEREAS, the City has determined that the health and safety of unsheltered persons in the City is threatened by a lack of shelter and as such the City has committed to combatting homelessness and creating or augmenting a continuum of shelter and service options for those living without shelter in our communities; and WHEREAS, pursuant to Government Code section 8698.2, the City Council adopted Resolution No. 15726 on December 17, 2018, declaring a shelter crisis and finding that a significant number of persons within the jurisdiction of the governing body were without the ability to obtain shelter and that the health and safety of persons was threatened by a lack of shelter; and WHEREAS, the City has identified a significant need for emergency sheltering and temporary measures such as overnight safe parking; and WHEREAS, to address this need, the City Council is providing individuals and families living in recreational vehicles a temporary safe place to park in a City -owned parking lot while they pursue other more permanent supportive housing and established a two-year Temporary Recreational Vehicle ("RV") Safe Parking Program ("Temporary Safe Parking Program"), approved by the City Council via Resolution No. 15881 on August 24, 2020; and WHEREAS, on September 25, 2020, Governor Gavin Newsom signed AB 2553, which expanded Government Code 8698.4, to provide, among other things, certain protections to all cities and counties against liability for those homeless shelters allowed or constructed during a declaration of shelter crisis; and WHEREAS, AB 2553 also amends the definition of "Homeless shelter" to include a "parking lot owned or leased by a city, county, or city and county specifically identified as one allowed for safe parking by homeless and unstably housed individuals"; and WHEREAS, pursuant to Government Code section 8698.4(a)(1), emergency housing may include homeless shelters for the homeless located or constructed on any land owned or leased by a city, county, or city and county, including land acquired with low- and moderate -income housing funds; and WHEREAS, in accordance with Government Code section 8698.4(a)(2)(A)(i), a city, in lieu of compliance with local building approval procedures or state housing, health, habitability, planning and zoning, or safety standards, procedures and laws, may adopt by ordinance reasonable local standards and procedures for the design, site ATTY/ORD.533/CC ORD SAFE PARKING PROGRAM REV: 04-06-21 RL Page 1 of 18 359
