6.M. - Page 6 of 22 development, and operation of homeless shelters and the structures and facilities therein, to the extent that strict compliance with state and local standards or laws would in any way prevent, hinder, or delay the mitigation of the effects of the shelter crisis; and WHEREAS, for a jurisdiction that adopts such an ordinance establishing reasonable local standards, pursuant to Government Code section 8698.4(a)(2)(A)(i), those standards must meet the minimum standards provided in the 2019 California Residential Code Appendix X, and the 2019 California Building Code Appendix O, and any future standards adopted by the Department of Housing and Community Development related to emergency housing or emergency housing facilities, unless findings are adopted stating why the standards cannot be met and stating how the standards in the ordinance protect health and safety; and WHEREAS, the City cannot meet the minimum standards set forth in the 2019 California Residential Code Appendix X or the 2019 California Building Code Appendix O, for the Temporary Safe Parking Program and now desires to adopt the findings set forth in this ordinance, stating why those minimum standards cannot be met and why the local standards in the ordinance protect health and safety for the operation of the Temporary Safe Parking Program in order that the City may avail itself of the protections afforded by AB 2553. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: Section 1. Recitals. The recitals set forth above are true and correct, and are hereby incorporated herein by this reference as if fully set forth in their entirety. Section 2. Findings. The City Council of Redwood City hereby makes the following findings pursuant to Government Code section 8698.4(a)(2)(A)(i) to identify the reasons why the City cannot meet the minimum standards provided in the 2019 California Residential Code Appendix X or the 2019 California Building Code Appendix O related to the emergency shelter being offered by the City through the Temporary Safe Parking Program. A. A significant number of persons in Redwood City are without the ability to obtain shelter, and this situation has resulted in a threat to the health and safety of these persons, for the reasons set forth in the recitals. The Council therefore hereby reaffirms the declaration of shelter crisis adopted via Resolution No. 15726 and finds that strict compliance with state and local standards or laws in existence at this time relating to emergency shelters or housing would prevent, hinder, or delay the mitigation of the effects of the shelter crisis. B. The City is currently utilizing a City -owned parking lot located at 1402 Maple Street, Redwood City, California ("Parking Site") as the location to allow certain types and numbers of stand-alone, non-dependent RVs being utilized by individuals who have been approved to participate in the Temporary Safe Parking Program ("Program Participant").
