6.M. - Page 7 of 22 Building Code, Appendix O ("Appendix O") or the 2019 California Residential Code, Appendix X ("Appendix X"), as identified herein, for the reasons set forth below. 1) Minimum Standards in Appendix O, Section 0103/Appendix X, Section AX103: The Subsections in this Section 0103/AX103 provide minimum standards relating to "Emergency Housing," which is defined as "[h]ousing in a permanent or temporary structure(s), occupied during a declaration of state of emergency, local emergency, or shelter crisis. Emergency housing may include, but is not limited to, buildings and structures constructed in accordance with the California Building Standards Code; and emergency sleeping cabins, emergency transportable housing units, and tents constructed in accordance with this appendix." a. Minimum Standards in Subsections 0103.1/AX103.1("General") states, "[e]mergency sleeping cabins, emergency transportable housing units, membrane structures and tents constructed and/or assembled in accordance with this appendix, shall be occupied only during declaration of state of emergency, local emergency, or shelter crisis. Buildings and structures constructed in accordance with the California Building Standards Code, used as emergency housing, shall be permitted to be permanently occupied." The City cannot meet the foregoing "General" minimum standards because the City is not utilizing or providing any emergency sleeping cabins, emergency transportable housing units, membrane structures or tents for emergency housing as part of the emergency shelter offered through the Temporary Safe Parking Program. The City is also not utilizing or providing any buildings or structures for emergency housing as part of the emergency shelter offered through the Temporary Safe Parking Program. Additionally, the City is not providing the RVs as part of the emergency shelter offered through the Temporary Safe Parking Program. The RVs participating in the Temporary Safe Parking Program are stand-alone units that are parking at the Parking Site. The RVs are owned by the Program Participants and not within the City's control and therefore the City cannot confirm that the RVs meet the minimum general standards in these Subsections. Notwithstanding the foregoing, the Temporary Safe Parking Program is a two- year program wherein the City offers Program Participants the opportunity to park their RVs, on a temporary basis, at the Parking Site during a period that the City has declared a shelter crisis. b. Minimum Standards in Subsections 0103.2/AX103.2 ("Existing Buildings") states, "[e]xisting residential and nonresidential buildings or structures shall be permitted to be used as emergency housing and emergency housing facilities provided such buildings or structures comply with the building code provisions and/or other regulations in effect at the time of original construction and/or alteration.
