The City cannot meet the foregoing "Existing Buildings" minimum standards because the City is not utilizing or providing any existing residential or nonresidential buildings or structures for emergency housing as part of any emergency shelter offered through the Temporary Safe Parking Program. Additionally, the City is not providing the RVs as part of the emergency shelter offered through the Temporary Safe Parking Program. The RVs participating in the Temporary Safe Parking Program are stand-alone units that are parking at the Parking Site. The RVs are owned by the Program Participants and not within the City's control and therefore the City cannot confirm that the RVs meet the minimum standards in these Subsections. Notwithstanding the foregoing, the City does offer Program Participants the opportunity to park their RVs, on a temporary basis, at the Parking Site during a period that the City has declared a shelter crisis. The City has established standards, identified herein, that protect health and safety for the operation of the Temporary Safe Parking Program and which address the condition of the RV by requiring, among other things, that the RV be in an operable condition. c. Minimum Standards in Subsections 0103.3/AX103.3 ("Occupant Load") states, "[e]xcept as otherwise stated in this appendix, the maximum occupant load allowed in buildings and structures used as emergency housing shall be determined by the enforcing agency, but the interior floor area shall not be less than 70 square feet (6.5 m2) for one occupant. Where more than one person occupies the building/structure, the required floor area shall be increased at the rate of 50 square feet (4.65 m2) for each occupant in excess of one. Exceptions: 1) Tents. 2) Recreational vehicles and park trailers designed for human habitation that meet the requirements in the Health and Safety Code, Sections 18009.3 and 18010, as applicable." The City cannot meet the foregoing "Occupant Load" minimum standards because the City is not utilizing or providing any existing buildings or structures for emergency housing as part of any emergency shelter offered through the Temporary Safe Parking Program. Although the definition of RV in the Temporary Safe Parking Program includes vehicles that meet the requirements in the Health and Safety Code sections 18009.3 and 18010 and would be excepted from the "Occupant Load" minimum standards, there are a number of other types of vehicles included in the definition of RV, which would not be excepted from these standards. For those vehicles included in the definition of RV that are not excepted, the City cannot meet the foregoing "Occupant Load" minimum standards because the City is not providing the RVs as part of the emergency shelter offered through the Temporary Safe Parking Program. The RVs participating in the Temporary Safe Parking Program are stand-alone units. The RVs are owned by Program Participants and not within the City's control and therefore the City cannot confirm that the RVs meet the minimum occupant load standards in these Subsections.
