ORDINANCE NO. 2495 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY AMENDING SECTION 27.100 OF THE REDWOOD CITY <br />MUNICIPAL CODE RELATING TO SANITARY SEWERAGE SERVICE <br />CHARGES <br />WHEREAS, on June 24, 2019, the City Council of the City of Redwood City ("City") <br />adopted Ordinance No. 2464, which established and levied sewer service charges upon each <br />premises or any portion thereof that receives or uses sewerage service from the City's sewerage <br />facilities; and <br />WHEREAS, the sewer service charges were adopted in compliance with Article XIIID, <br />Section 6 of the California Constitution, Government Code section 53750 et seq., and Health and <br />Safety Code section 5471; and <br />WHEREAS, the City currently imposes the sewer service charges, set by Ordinance No. <br />2464, on a monthly basis; and <br />WHEREAS, the City would like to have the option of imposing the previously adopted <br />sewer service charges on Residential Customers with one (1) dwelling unit on an annual basis; <br />and <br />WHEREAS, the City Council would like to have the option of collecting the previously <br />adopted sewer service charges for Residential Customers with one (1) dwelling unit on the tax <br />roll pursuant to Health and Safety Code section 5473 et seq.; and <br />WHEREAS, imposing the sewer services charges on an annual, rather than a monthly, <br />basis will not result in an increase in the charges, pursuant to Article XIIID, Section 6 of the <br />California Constitution or Government Code section 53750, because neither the rate or the <br />methodology used to calculate the charges is being changed and the total annual sewer service <br />charges for any sewer service customer will not be increased. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />REDWOOD CITY AS FOLLOWS: <br />Section 1. The recitals set forth above are true and correct, and are hereby incorporated <br />herein by this reference as if fully set forth in their entirety. <br />Section 2. The City Council of the City of Redwood City adopts the amendments to <br />Chapter 27, Article IX, Section 27.100 by adding the text shown in double underline (underline) <br />and deleting the text shown in strikeout (example), as shown below. <br />ATiY/ORD.536/CC ORD AMENDING SEWER SERVICE CHARGES ORD.
