The CITY OF REDWOOD CITY, a uunicipal corporation, herein- <br /> after referred, to as "City ; , and JOHN E. LAYNG, ARTHUR N. BLOM- <br /> QUIST, and IRVIN C. BLOMQUIST, hereinafter referred to as <br /> °Layyne , mutually agree as follows: <br /> 1. As the full purchase price for property conveyed to <br /> City by Layng in deeds dated December 1, 1948 , City will pay to <br /> Layng the sum of Seventeen Thousand Two Hundred Fifty-Nine and <br /> 30/100 Dollars ($17, 259.30) . Reference is hereby made to the <br /> aforementioned deeds for a particular description of the prop- <br /> erty ce-nveyed. Taxes on the ro ert <br /> P P Y conveyed will, be prorated <br /> as of March 10, 1948. <br /> 2. City will be bound by the terms of that certain deed <br /> from S. H. Frank Co . to John E. Layng, Arthur N. Blornquist <br /> and. Irvin C . Blomquist, dated January 6, 1948, recorded January <br /> 27, 1945 in <br /> Volume 1.144 of Official Records, at page 213, which <br /> deed excepts and reserves unto S. H. Frank & Co . , its successors <br /> and assigns, the right to take and appropriate p <br /> P P water <br /> from the <br /> existing well now located on the property described in said deed, <br /> at the rear thereof near Steinberger Street, until such time as <br /> said well goes permanently dry or is abandoned by grantor, its <br /> successors or assigns, together with the <br /> right of access to said <br /> well over said real property, for the purpose of maintaining said, <br /> well and maintaining and repairing and replacing the pipe lines <br /> and other apparatus connecting said well, and the title to said <br /> pipe lines and apparatus. <br /> 3. City will maintain the existing drainage system along <br /> the easterly edge of Steinberger Street so that the natural <br /> drainage capacity heretofore provided by said ditch will not be <br /> interfered with or lessened in any manner, and Layng will not <br /> -1- <br />
