REV: 10-26-21 SK <br /> REVOCABLE LICENSE AGREEMENT <br />BETWEEN THE CITY OF REDWOOD CITY AND <br />CITIZENS FOR EMERGENCY RESPONSE AND PREPAREDNESS PROGRAM, INC. <br />THIS REVOCABLE LICENSE AGREEMENT ("Agreement") is made and <br />entered into as of the ________ day of ____________________ 2021 ("Effective Date"), <br />by and between the City of Redwood City, a charter city and municipal corporation of the <br />State of California (“City”), and the Citizens for Emergency Response and Preparedness <br />Program, Inc., a California corporation ("Licensee") (collective, “Parties”). <br />RECITALS <br />A. Licensee is a corporation promoting community-based disaster <br />preparedness and response in the Woodside Fire Protection District, which includes the <br />Town of Woodside. <br />B. Licensee desires to install and operate radio antenna equipment on <br />property owned and maintained by City. The City property, Easter Cross Water Tank site, <br />is located at 555 California Way in Redwood City, CA, 94062 (APN: 068-173-300). <br />C. City desires to grant to Licensee a revocable license to operate equipment <br />at the site on the terms and conditions contained in this Agreement, provided that the <br />public health, safety and welfare are not thereby impinged, diminished or adversely <br />affected. <br />D. All Parties to this Agreement have had the opportunity to have this <br />agreement reviewed by their attorney. <br />AGREEMENT <br />NOW, THEREFORE, in consideration of the recitals and mutual obligations <br />contained herein, Parties agree as follows: <br />1. Nature of Agreement. The nature of the right granted by City to Licensee is <br />that of a revocable license and not a permit nor a lease. No property right is granted <br />hereby. Notwithstanding the foregoing, Licensee hereby knowingly waives and <br />relinquishes any rights it may have or claim to have pursuant to California Government <br />Code Sections 7260 through 7277. <br />2. License Area. The real property permitted to be used under this Agreement <br />is a portion (“Site") of that certain City property (site of the Easter Cross Water Tank site) <br />located at 555 California Way, Redwood City, CA, 94062 ("City Property").
