REV: 10-26-21 SK <br />d. The Licensee is not permitted to cut any padlock (except their own) <br />or link of chain securing the gate. Should the Licensee or an agent of the Licensee <br />cut any padlock or length of chain other than their own padlock the Licensee shall <br />be responsible for the cost to replace the cut lock or chain. <br />e. Installation of padlocks shall be coordinated with Public Works <br />Service Department, Water Utility Services Division staff. <br />f. Access to the roof of the water reservoir shall be coordinated with <br />Public Works Service Department, Water Utility Services Division staff. <br />g. Any individuals utilizing the ladder and accessing the water reservoir <br />roof shall do so in compliance with all safety regulations and shall provide their <br />own safety equipment. <br />h. The Licensee shall not be permitted to place a padlock on the water <br />reservoir. <br />i. At no time shall the Licensee leave the gates unlocked while not on- <br />site. Gates shall be locked when Licensee leaves the facility for any reason and <br />for any duration of time. <br />7. Payment. No payment is required of the Licensee for use of the Site or <br />electricity used by Licensee’s equipment. <br />8. Restoration of Property. Within ninety days (90) days of vacating the Site, <br />Licensee agrees to restore the Site to as good a condition as existed at the <br />commencement of this Agreement or to the satisfaction of City, whichever is least costly. <br />9. Ownership of Equipment. It is agreed by the Parties that the radio antenna <br />equipment installed at the Site by Licensee shall remain the property of Licensee. City <br />shall not be responsible or liable in any ways or forms related to Licensee’s equipment <br />operations and functions. On termination of this Agreement by any means, Licensee shall <br />have the right without further notice to City to remove any and all of the radio antenna <br />equipment belonging to Licensee and installed at the Site. <br />10. Risk of Damage to Equipment. Licensee assumes the full risk and <br />responsibility for any loss, destruction, or damage occurring to the radio antenna <br />equipment. <br />11. Compliance with Laws and Regulations. Licensee shall at all times comply <br />with, and shall pay all costs, expenses, penalties and fines which may be incurred or <br />required to be paid in order to comply with, any and all permitting requirements, laws, <br />statutes, labor codes, ordinances, rules and regulations, including any and all laws or <br />regulations relating to hazardous materials, toxic materials, substances or waste, or <br />public health, safety and welfare and the protection of the environment, the Americans <br />ATTY/AGR.2021.270/Citizens for Emergency Response and Preparedness Program, Inc.
