Construction Services Agreement <br />REV: 04-26-2021 PR <br />00 5205 - 36 <br /> <br /> <br />subcontractors, the approved ratios of apprentices and trainees to journeymen, prior <br />to the use of the apprentices of the job site. <br /> b) Trainees will not be permitted to work at less than the predetermined rate for the <br />work performed unless they are employed pursuant to and individually registered in <br />a program which has received prior approval, evidenced by formal certification, by <br />the U. S. Department of Labor, Manpower Administration, Bureau of Apprenticeship <br />and Training. The ratio of trainees to journeymen shall not be greater than permitted <br />under the plan approved by the Bureau of Apprenticeship and Training. Every <br />trainee must be paid at not less than the rate specified in the approved program for <br />his level of progress. Any employee listed on the payroll at a trainee rate who is not <br />registered and participating in a training plan approved by the Bureau of <br />Apprenticeship and Training shall be paid not less than the wage rate determined <br />by the Secretary of Labor for the classification of work he actually performed. The <br />contractor or subcontractor shall be required to furnish HUD written evidence of the <br />certification of his program, the registration of the trainees, and the ratios and wage <br />rates prescribed in that program. In the event the Bureau of Apprenticeship and <br />Training withdraws approval of a training program, the contractor will no longer be <br />permitted to utilize trainees at less than the applicable predetermined rate for the <br />work performed until an acceptable program is approved. <br /> <br /> <br />ATTENTION: <br />You are advised that the City will require strict adherence to the ratio approved under the <br />registered program, and will require back wage adjustments (to the journeyman's rate) for <br />any apprentice or trainee who is employed on the job site in excess of the approved ratio. <br />This ratio must be observed ON THE JOB SITE irrespective of the employer's compliance <br />with the ratio which is in force at the time of the effective date for the wage decision as <br />defined, above, in accordance with DOL Regulations. <br />Supervisory or management personnel who are at the job site and who are not performing <br />construction work may be counted as journeymen for the purpose of demonstrating <br />compliance with the apprenticeship/trainee ratio. These personnel must be listed on the <br />payroll reports in order to be considered for this purpose. <br />7. The Copeland Act (Anti-Kickback Act) provides that no deduction or rebate on any account <br />be taken from an employee's pay, except such deductions as are mandatory by law, unless <br />this deduction is authorized in writing by the employee. A copy of the signed authorization <br />must be submitted with the payroll on which the deduction appears. One signed <br />authorization is sufficient for deductions made on a regular basis. <br />8. Overtime Compensation -
