Construction Services Agreement <br />REV: 04-26-2021 PR <br />00 5205 - 47 <br /> <br /> <br />Pursuant to 24 CFR 75.19(b), contractors and subcontractors must, to the <br />greatest extent feasible, ensure business concerns that provide economic <br />opportunities to Section 3 workers residing within the area in which the Section <br />3 projects are located are provided with contracts for work awarded in <br />connection with Section 3 projects. Where feasible, contractors and <br />subcontractors should give priority for contracting opportunities to: <br /> <br />1. Section 3 business concerns that provide economic opportunities to <br />Section 3 workers residing within the service area or the <br />neighborhood of the project, and <br /> <br />2. YouthBuild programs. <br /> <br />All employment and training opportunities, and contracting awards provided in <br />accordance with 24 CFR 75.19 must be consistent with Federal, state, and local laws <br />and regulations. Ultimately, in addition to meeting prescribed benchmarks, contractors <br />and subcontractors will need to certify that they have followed the prioritization of effort <br />in 24 CFR 75.19 to demonstrate compliance (see Section VI). <br />8. Establishing the Number of Trainees <br /> For building and construction occupations, the number of trainees or apprentices for each <br />occupation shall be that number which can reasonably be utilized in each occupation on <br />each phase of a Section 3 covered project and in no event shall that number be less than <br />the number of trainees or apprentices determined by the Secretary of Labor for each building <br />construction occupation. <br /> The City of Redwood City will monitor the ratio of apprentices to employees pursuant to <br />regulations of the Secretary of Labor and shall establish ratios of apprentices to employees <br />based upon usual local employment practices for occupations which do not have ratios <br />established by the Secretary of Labor. <br /> For nonconstruction occupations or for any building construction occupation for which ratios <br />are not determined pursuant to regulations of the Secretary of Labor, the number of trainees <br />for each occupation shall be that number which can reasonably be utilized in each <br />occupation on each phase of a Section 3 covered project. The City of Redwood City and <br />contractor, shall initially determine the maximum number of trainees for each occupation. <br />9. Documentation <br /> Contractor needs to provide evidence of qualitative efforts made to assist low and very <br />low-income persons with employment and training opportunities, if benchmarks not <br />met. <br /> Example Qualitative Efforts to Document and send to City Staff by the <br />termination of the contract: <br />o Outreach to generate job applicants who are Section 3 Workers, <br />Targeted Section 3 Workers, YouthBuild participants, or Section <br />3 Business Concerns
