ORIGINAL <br />INDEMNITY AGREEMENT <br />THIS AGREEMENT is made and entered into as of the 10k day of January, <br />2021, by and between the CITY OF REDWOOD CITY, a charter city and municipal <br />corporation of the State of California ("City"), and Leslie Lynn Tozzini, an individual <br />("Tozzini"). <br />RECITALS <br />1. On December 19, 2020, Douglas Tozzini was detained by the Redwood <br />City Police Department ("RCPD") pursuant to California Welfare & Institutions Code <br />Section 5150. <br />2. Tozzini is the legal spouse of Douglas Tozzini and resided with him on at <br />the time of his above-described detention on December 19, 2020. <br />3. Subsequent to that detention, RCPD confiscated one Acme Arms Co. side <br />by side 12 gauge shotgun (no serial number), one antique flintlock rifle (no serial number), <br />one Hampton Precussion Cap Rifle (no serial number), one J. Stevens Arms .22 LR Barrel <br />and Firing Assembly (no serial number), and one Steyr 1914 Model 359 Jefferson Rifle <br />(serial number 6382), pursuant to California Welfare & Institutions Code Section 8102. <br />4. City and Tozzini have negotiated and agreed to release the firearms and <br />safe keys to a licensed firearms dealer, who may transfer the items to Tozzini's son, Gian <br />Tozzini. Tozzini agrees that she shall not allow Douglas Tozzini to have access to said <br />firearms or keys. <br />NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br />contained herein, the Parties agree as follows: <br />1. Transfer of Firearms and Gun Safe Ke . Within ten (10) days of execution of <br />this Agreement, the following firearms and gun safe key shall be released to a <br />federally licensed firearms dealer, who may transfer the items to Gian Tozzini, who <br />resides at 1336 Capistrano Dr., Pacifica, CA, 94044: Acme Arms Co. side by side <br />12 gauge shotgun (no serial number), one custom built MC 15 (177) Air Rifle (serial <br />number 1231693), one antique flintlock rifle (no serial number), one Hampton <br />Precussion Cap Rifle (no serial number), one J. Stevens Arms .22 LR Barrel and <br />Firing Assembly (no serial number), and one Steyr 1914 Model 359 Jefferson Rifle <br />(serial number 6382). <br />Said firearms shall never be sold or otherwise transferred to Douglas Tozzini, nor <br />shall said firearms ever be in Douglas Tozzini's possession, control or located at <br />Douglas Tozzini's residence. <br />ATTY/AGR/2021.005/TOZZINI WAIVER <br />REV: 01-11-2021 RL <br />Page 1 of 3 <br />
