Map for the South Main Planning Area ("Project"), prepared by Talus and dated October 12, 2020 ("Tentative Map"), subject to certain conditions of approval ("Conditions"). C. The Conditions require either (1) that certain public improvements for the Project be constructed prior to approval of the final map ("Final Map"), or (2) that Developer enter into an agreement with City providing for the future construction of such public improvements. D. Developer has submitted the Final Map and applied to City for Final Map approval without having completed the required public improvements and, therefore, will enter into an agreement with City providing for the future construction and installation of such public improvements, as required by Government Code section 66462(a)(1). E. Developer has submitted to City plans, specifications and drawings entitled (a) Improvement Plans for 1601 EI Camino Real (CP 20-0265), prepared by Talus Engineering and dated January 14, 2022; (b) Improvement Plans for South Main Recycled Water Extension, prepared by Talus Engineering and dated September 17, 2021; (c) Improvement Plans for South Main Sanitary Sewer Mitigation, prepared by Talus Engineering and dated January 6, 2022; (d) Improvement Plans for Woodside Rd, Pine & Main St. Intersection, prepared by Talus Engineering and dated October 21, 2021; (e) Improvement Plans for Redwood Avenue Traffic Calming, prepared by Talus Engineering and dated October 29, 2021; (f) Improvement Agreement Alternative Exhibit regarding Lathrop Triangle prepared by Talus Engineering, dated March 11, 2022 ("Alternative Lathrop Triangle Plan"); (g) Dog Park Construction Approach, prepared by WRS STUDIO, dated March 9, 2022 ("Dog Park Plans"); and (h) Community Garden and Landscape Character and Amenities, prepared by WRS STUDIO, dated February 14, 2020 ("Community Garden Plans") copies of which are on file with the City (collectively, the "Improvement Plans"), which, in addition to other improvements, provide for certain on-site public improvements consisting of street and street light improvements, storm drain systems, domestic water systems and sanitary sewer systems for the Project (collectively, "Improvements"). F. Upon approval and recordation of the Final Map, the Property will reconfigure the existing twenty (20) parcels and right of ways to create five (5) new parcels. G. City and Developer desire to enter into this Agreement providing for the construction and installation of the Improvements in accordance with the Improvement Plans. AGREEMENT NOW, THEREFORE, in consideration of the faithful performance of the terms and conditions set forth in this Agreement, the Parties hereto agree as follows: 1. Purpose. The purpose of this Agreement is to guarantee completion of the Improvements and ensure satisfactory performance by Developer of Developer's obligations to satisfy the Conditions pertaining to the Improvements.
