Map for the South Main Planning Area ("Project"), prepared by Talus and dated October <br />12, 2020 ("Tentative Map"), subject to certain conditions of approval ("Conditions"). <br />C. The Conditions require either (1) that certain public improvements for the <br />Project be constructed prior to approval of the final map ("Final Map"), or (2) that <br />Developer enter into an agreement with City providing for the future construction of such <br />public improvements. <br />D. Developer has submitted the Final Map and applied to City for Final Map <br />approval without having completed the required public improvements and, therefore, will <br />enter into an agreement with City providing for the future construction and installation of <br />such public improvements, as required by Government Code section 66462(a)(1). <br />E. Developer has submitted to City plans, specifications and drawings entitled <br />(a) Improvement Plans for 1601 EI Camino Real (CP 20-0265), prepared by Talus <br />Engineering and dated January 14, 2022; (b) Improvement Plans for South Main <br />Recycled Water Extension, prepared by Talus Engineering and dated September 17, <br />2021; (c) Improvement Plans for South Main Sanitary Sewer Mitigation, prepared by <br />Talus Engineering and dated January 6, 2022; (d) Improvement Plans for Woodside Rd, <br />Pine & Main St. Intersection, prepared by Talus Engineering and dated October 21, 2021; <br />(e) Improvement Plans for Redwood Avenue Traffic Calming, prepared by Talus <br />Engineering and dated October 29, 2021; (f) Improvement Agreement Alternative Exhibit <br />regarding Lathrop Triangle prepared by Talus Engineering, dated March 11, 2022 <br />("Alternative Lathrop Triangle Plan"); (g) Dog Park Construction Approach, prepared by <br />WRS STUDIO, dated March 9, 2022 ("Dog Park Plans"); and (h) Community Garden and <br />Landscape Character and Amenities, prepared by WRS STUDIO, dated February 14, <br />2020 ("Community Garden Plans") copies of which are on file with the City (collectively, <br />the "Improvement Plans"), which, in addition to other improvements, provide for certain <br />on-site public improvements consisting of street and street light improvements, storm <br />drain systems, domestic water systems and sanitary sewer systems for the Project <br />(collectively, "Improvements"). <br />F. Upon approval and recordation of the Final Map, the Property will <br />reconfigure the existing twenty (20) parcels and right of ways to create five (5) new <br />parcels. <br />G. City and Developer desire to enter into this Agreement providing for the <br />construction and installation of the Improvements in accordance with the Improvement <br />Plans. <br />AGREEMENT <br />NOW, THEREFORE, in consideration of the faithful performance of the terms and <br />conditions set forth in this Agreement, the Parties hereto agree as follows: <br />1. Purpose.
