2. Property Suhfect to Agreement. The Property will be subject to this <br />Agreement. <br />3. Duty to Install Improvements. <br />3.1 Developer will construct, install and complete, or cause to be <br />constructed, installed and completed, at Developer's sole cost and expense, the <br />Improvements, in accordance with(1) the Improvement Plans, as such Plan may <br />be modified as provided in this Agreement; (2) all requirements of State and local <br />law, including the City of Redwood City Municipal Code; (3) the Conditions; (4) any <br />applicable mitigation measures and (5) to the satisfaction of the City Engineer, in <br />their reasonable discretion. Developer will also supply all labor and materials <br />therefor, all in strict accordance with the terms and conditions of this Agreement. <br />The Improvements will include all Improvements shown on the Improvement <br />Plans, but are not necessarily limited to, all of the following: <br />REV: 04-07-2022 SK <br />(a) grading, paving; <br />(b) curbs, gutters, concrete walkways, driveways; <br />(c) sanitary sewer system; <br />(d) domestic and recycled water systems; <br />(e) storm drainage system; <br />(f) site lighting system; <br />(g) street trees; <br />(h) landscaping and irrigation system; <br />(i) utility joint trenching; <br />0) park improvements including the Main Street Dog Park Improvements; <br />(k) Community garden improvements consistent with the Community <br />Garden Plans; <br />(1) all other improvements, both on-site and off-site included in the <br />Conditions of the Tentative Map; and <br />(m) all other work, improvements, or construction required by or specified <br />in the Improvement Plans, the Conditions or any other approvals from <br />the City and all construction, appurtenances and improvements <br />necessary as reasonably determined by the City Engineer to complete <br />the aforementioned improvements, both within and outside of the <br />Property. <br />ATTY/AGR.2022.083/South Main SIA (Page 3 of 26) <br />
