The proposed subdivision design overall, along with the siting <br />(frontages facing Finger per a. above and use of porches and other <br />features) and architecture (varied and traditional per b. above) of the <br />individual homes has been coordinated to present a development that <br />appears as an extension of the existing neighborhood and represents <br />many of the characteristics (e.g. consistent front yard setbacks from <br />Finger Avenue, lot coverage and height limit compliance) that result <br />from the application of R-1 Zoning standards, as perceived from the <br />adjacent neighborhood. <br /> <br />e. Guest parking (although not required in the R-1 Single Family Zoning <br />District) would be included within the proposed development. <br /> <br />f. The development would not be gated and therefore will be integrated into <br />the existing neighborhood. <br /> <br />g. Mitigation through setbacks and landscaping were determined to respect <br />the important adjacent Finger Farmhouse which has local and possibly <br />higher level historic significance. <br /> <br />B. TWENTY FIVE FOOT SETBACK TO CORDillERAS CREEK - SPECIAL <br />CONSIDERATION OF PLANNED DEVELOPMENT PERMIT <br /> <br />1. Recommendation: The City Council uphold the appeal and approve the <br />reduced creek setback modification through the Planned Development Permit <br />with the following conditions that (1) portions of the houses on Lots 1 - 4 shall <br />encroach no closer than 15 feet to the Top of Bank (TOB) and (2) the storm <br />drain system shall be designed as shown on the Utility Plan with Alternative <br />Storm Drainage Connection to EI Camino Real dated April 20, 2009, and also <br />on the Vesting Tentative Map dated October 19,2009, subject to the changes <br />in the project and the revised conditions of approval as set forth in Attachment <br />4. <br /> <br />Findinas: <br />That pursuant to Zoning Ordinance Section 32. 12(F)(3), which presents <br />specific requirements for development near creeks, and Section 42.3, which <br />sets forth additional findings for granting any Use Permit, including the <br />consideration of conditional uses as part of a Planned Development Permit <br />review, the City Council approves the creek setback modifications because: <br /> <br />a. Any disturbed riparian vegetation would be replaced. The applicant would <br />also provide landscaping enhancements along the creek with native <br />riparian trees and vegetation, which would improve the creek's <br />appearance and natural character. <br /> <br />2 <br />
