The development would maintain the stability of the slopes of the creek <br />bank because the applicant is proposing a utility plan with storm drainage <br />directed to El Camino and any development within 30 feet of the toe of the <br />creek bank would be constructed on piers and grade beam foundations. <br />The project wit! not include any modifications to the creek bank (except <br />reestablishment of riparian vegetation) and the structures that will be built <br />as part of the project will not bear any loads on the creek bank. <br /> <br />c. The development would be designed to avoid discharge of pollutants <br />directly to the watercourse and would assure that the discharge of runoff <br />would be filtered over a minimum of twenty-five (25) feet of vegetation or <br />through other equivalent means to the satisfaction of the Engineering and <br />Construction. The proposed stormwater system includes filtration and <br />controlled discharge into the City storm drain system and will not degrade <br />water quality. <br /> <br />d. The establishment, maintenance, or operation of the use applied for would <br />not, under the circumstances of the particular case, be detri.mental to the <br />health, safety, peace, morals, comfort, or general welfare of persons <br />residing or working in the neighborhood of such proposed use or would <br />not be detrimental or injurious to property or improvements in the <br />neighborhood or to the general welfare of the City for the following <br />reasons: <br /> <br />1. Many existing homes along Cordilleras Creek in the vicinity of the <br />project site do not maintain a 25-foot setback to TOB, so the proposed <br />houses would not be inconsistent with the existing pattern of residential <br />development. <br /> <br />2. Maintaining a 15-foot TOB creek setback would provide a 15-foot wide <br />rear yard outside of the creek channel for each home along the creek. <br /> <br />3. The 15-foot setback from TOB would provide an adequate area for the <br />property owners to bring in equipment for creek maintenance upon city <br />approval. <br /> <br />4. A "no-build" easement on Lots 1 to 4 would ensure that the purchasers <br />of these lots and future owners are aware that no permanent <br />structures, and no additional impervious surfaces would be allowed <br />within 15-feet from the TOB, which limits rear yards improvements. <br /> <br />C. PRIVATE STREET DESIGN EXCEPTION - SPECIAL CONSIDERATION OF <br />PLANNED DEVELOPMENT PERMIT <br /> <br />1. Recommendation: That City Council approve the requested reduction in <br />street width from 25 ft. to 22 ft. for a one-way street and the inclusion of a 4 ft. <br /> <br />3 <br />
