There are no other such findings of conflict with written public policy or with the <br />public interest as the City Council may determine. <br /> <br />The other significant policy issue for the project is the encroachment within the <br />25-foot creek setback. The Community Development Director determined that a <br />15 foot setback from the top of creek bank is adequate in this case for the sake <br />of storm water control and believes that the developer's proposal meets the <br />findings as set forth in the creek setback ordinance as summarized here: <br /> <br />a. Protection of Existing Riparian Habitat: Any disturbed riparian vegetation will <br />be replaced. <br /> <br />b. Creek Bank Stability: The foundations of the new structure (pier/grade beam) <br />should not impose any loads on the creek bank. <br /> <br />c. Creek Water Quality: Water quality was reasonably assured as determined <br />from engineering analysis of the applicant's proposed storm water detention <br />system which includes filtration through the use of ground Filterra units and <br />subsurface piping prior to controlled discharge of storm water to Finger <br />Avenue. <br /> <br />6 <br />
