There are no other such findings of conflict with written public policy or with the
public interest as the City Council may determine.

The other significant policy issue for the project is the encroachment within the
25-foot creek setback. The Community Development Director determined that a
15 foot setback from the top of creek bank is adequate in this case for the sake
of storm water control and believes that the developer's proposal meets the
findings as set forth in the creek setback ordinance as summarized here:

a. Protection of Existing Riparian Habitat: Any disturbed riparian vegetation will
be replaced.

b. Creek Bank Stability: The foundations of the new structure (pier/grade beam)
should not impose any loads on the creek bank.

c. Creek Water Quality: Water quality was reasonably assured as determined
from engineering analysis of the applicant's proposed storm water detention
system which includes filtration through the use of ground Filterra units and
subsurface piping prior to controlled discharge of storm water to Finger
Avenue.

6
