E TO STORMWATERT EATMFNT ME&SURES MAINTENANCE AGREEMENT THIS FIRST AMENDMENT TO Stormwater Treatment Me res Maintenance Agreement, 1180 Main Street, ("First Amendment") is made and entered into this day of .IQ -V V9- 2022 ("Effective Date"), by and between Premia 1180 Main Owner, LLC, a Delaware limited liability company ("Property Owner"), and the CITY OF REDWOOD CITY, a charter city and California municipal corporation ("City"). RECITALS A. The Property Owner and City entered into that certain Stormwater Treatment Measure Maintenance Agreement dated March 16, 2020 and recorded April 23, 2020 as instrument Number 2020- 036923, in the Official Records of the County of San Mateo ("Original Stormwater Treatment Measures Maintenance Agreement"). B. The Property Owner is the owner of real property commonly known as 1180 Main Street, Redwood City, CA 94043 (the "Property"), as more particularly described in Exhibit "A", attached to and incorporated by reference in Recital C of the Original Stormwater Treatment Measures Maintenance Agreement. C. The Original Stormwater Treatment Measures Maintenance Agreement included references to a legible reduced -scale copy of the site plan showing the stormwater treatment measures that are to be located or constructed on the Property ("Site Plan") and installed and maintained by the Property Owner as shown on Exhibit `B" attached to the Original Stormwater Treatment Measures Maintenance Agreement. D. The Original Stormwater Treatment Measures Maintenance Agreement included references to a copy of the Stormwater Treatment Operation and Maintenance Inspection Report describing the stormwater treatment measures that are to be located and maintained on the Property ("Inspection Report") by the Property Owner as shown on Exhibit "C" attached to the Original Stormwater Treatment Measures Maintenance Agreement. E. Since the recordation of the Original Stormwater Treatment Measures Maintenance Agreement, a revised plan for the site has been reviewed and approved by City staff which alters the stormwater treatment measures on the site. The Property Owner requested these modifications to the stormwater treatment measures, and in doing so, the Property Owner was required by City to alter the Site Plan and Inspection Report. F. As provided in Section 17 of the Original Stormwater Treatment Measures Maintenance Agreement, any amendments or modifications must be made in a writing signed by both Parties. G. The purpose of this First Amendment is to amend the Original Stormwater Treatment Measures Maintenance Agreement to replace the original Site Plan and Inspection Report with the revised Site Plan and Inspection Report.
