<br /> EAP Services Agreement <br />2 <br />G. "Group" The organization identified as such on the Cover Sheet of this Agreement. <br />H. "Limitation" Any provision of this Agreement which restricts Benefits, other than an Exclusion. <br /> <br />I. "Member" An eligible employee of Group, the eligible employee’s children under the age of 26, <br />persons covered under the eligible employee’s health benefit plan, persons residing with the eligible <br />employee, including domestic partners. <br />J. "Periodic Fees" The monthly amounts due and payable to Plan from Group for providing Benefits to <br />Members. <br /> <br />K. "Plan" Health and Human Resource Center, Inc., doing business as Aetna Resources For Living. <br />L. "Regulations" Those regulations promulgated and officially adopted under the Act. <br /> <br />M. "Service Area" Those areas in which Plan is licensed to operate. <br />II. CHOICE OF PROVIDERS <br />Benefits must be obtained from an EAP Provider through Plan. A Member may obtain Benefits by <br />contacting Plan at 1-800-342-8111. Upon contact, Plan will determine the Member's eligibility for <br />Benefits and arrange for Benefits. <br />III.BENEFITS <br />Subject to all of the terms, conditions, Limitations and Exclusions of this Agreement, Members are entitled <br />to receive Benefits as follows: <br />A. Obtaining Benefits. Unless otherwise specifically stated to the contrary, the services described herein <br />are Benefits only if, and to the extent, that they are authorized and directed by Plan and performed by <br />an EAP Provider. <br /> <br />B Non-EAP Providers. In the event Plan fails to pay a non-EAP Provider, the Member will be liable to <br />such non-EAP Provider for the cost of services provided to the Member. <br /> <br />C. Benefits. Benefits may be changed in accordance with Section XIII.A hereof. <br />IV. LIMITATIONS AND EXCLUSIONS <br />The rights of Members and the obligations of Plan hereunder are subject to the following Limitations and <br />Exclusions: <br />A. Limitation. In the event of any major disaster or epidemic, Plan shall provide Benefits to Members to <br />the extent practical, according to its best judgment, within the limitations of such facilities and <br />personnel as are then available.
