<br />ATTY/AGR/SETTLEMENTS/2023/SETTLEMENT AGREEMENT - 557 E. BAYSHORE ROAD <br />REV: 05-17-23 JB <br />#216638140_v1 51 <br />*Engineering Services are provided on an “Actual Cost” basis. Actual Costs are <br />determined by the fully burdened hourly rates by position performing services. <br />The rates are on file with the City Clerk. <br />*Deposits may be eligible for refund after a service has been provided, if the <br />cost of the service provided is less than the amount of the deposit. The City <br />shall determine when a service provided is complete, and shall send at least <br />three (3) written notifications over the course of one hundred eighty (180) days <br />that a deposit is eligible for a refund. Deposits that qualify for refund but that <br />have gone unclaimed for a period exceeding one hundred eighty (180) <br />calendar days shall be considered forfeited. Forfeited deposits shall be turned <br />over to the General Fund for general City operations. <br />F. Miscellaneous Permits <br />1. Use of Sanitary Sewage Facilities Administrative Charges (per Ordinance No. <br />2091, 8-12-1995) <br />a. Discharge Permit Deposit $300.00 <br />No significant user shall connect to or discharge <br />waste or wastewater into the sewerage facilities <br />without first obtaining a wastewater discharge <br />permit. <br /> <br />2. Storm Water Management and Discharge Control Program Administrative Charges <br />(per Ordinance No. 2090, 7-13-1995) <br />a. Stormwater Discharge Facility Deposit $300.00 <br />b. Permit for Monitoring, Sampling, <br />Metering, Facilities or Other Equipment <br />on Public Property <br />Deposit $500.00 <br />5. Sidewalk, Curb, Gutter Permit (Improvements are to be constructed within the <br />public right-of-way.) <br />To be applied for at the Building Division. <br />Based upon Municipal Code Section 29.90 and intended for use where <br />improvements are to be constructed within the public right-of-way involving <br />construction of sidewalks, curb and gutters, driveway approaches or other <br />minor excavations. <br />a. Permit Application Fee Fee $50.00 <br />b. Deposit <br />(refundable upon completion of <br />satisfactory work) <br />Deposit $500.00 <br />6. Utility Encroachment Permit <br />a. This fee is for short-term small-scale <br />utility encroachment permits intended to <br />cover small service upgrades or system <br />repairs on private utility systems, typically <br />lasting less than five working days. <br />b. The Engineering Division maintains its <br />existing authority to require a deposit for <br />projects lasting longer than five working <br />Fee 752.00
