ATTY/RESO.0028/PC RESO APPROVING 1201 MAIN WITH CONDITIONS OF APPROVAL <br />REV: 04-18-23 VR <br />Page 3 of 34 <br />WHEREAS, the Project requests one concession to increase building height from <br />60’ to 60’ 6”; and <br /> <br />WHEREAS, pursuant to State Density Bonus Law, the Project would be physically <br />precluded from being constructed at the proposed density and with the above concession <br />and therefore requests waivers to increase the Project’s Floor Area Ratio from 2.0 to 2.1, <br />to waive the pervious area requirement, to waive the 45-degree daylight plane <br />requirement, and to allow compact parking spaces for 16% of the total spaces. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION <br />OF THE CITY OF REDWOOD CITY AS FOLLOWS: <br /> <br />Section 1. The Planning Commission, having independently heard, considered, <br />and weighed all the evidence in the record, finds that the above recitals are accurate and <br />constitute findings in this matter and, together with the staff report and the application <br />materials, including without limitation all documents, reports, studies, memoranda, <br />maps, oral and written testimony, and materials in the City’s file for the applications <br />and the Project, and all adopted City planning documents relating to the Project and <br />the property including the City’s General Plan, Municipal Code, Zoning Ordinance, and <br />other applicable City laws and regulations, and all associated approved and certified <br />environmental documents, have together served as an adequate and appropriate <br />evidentiary basis for the findings and actions set forth in this Resolution. <br /> <br />Section 2. CEQA: The Planning Commission finds that the Project is exempt from <br />the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section <br />15332 (Class 32 – “Infill Development Projects”), as further explained in the CEQA <br />Exemption Memorandum (Attachment 6 to the Staff Report) dated March 29th, 2023, <br />because: <br />a. The project is consistent with the applicable general plan designation and <br />zoning regulations; and
