BAYSHORE – EXHIBIT A <br />REV: 05-12-23 JB <br />Page 17 of 30 <br />• Post a publicly visible sign with the telephone number and person to contact at <br />the lead agency regarding dust complaints. <br /> <br />Findings Regarding Impact AIR-3. City Council finds that incorporating the <br />requirements of the Standard Conditions of Approval implementing the Bay Area Air <br />Quality District’s best management practices, the District has determined reduce health <br />risks associated with regard to fugitive dust emissions from construction activities to <br />acceptable levels and, therefore, would not expose sensitive receptors to substantial <br />pollutant concentrations. This finding is based on the entire record of proceedings for the <br />Project, including but not limited to the discussion and analysis set forth on pages 32 <br />through 45 of the DEIR, which includes a full statement of the impact and applicable <br />mitigation measures and is hereby incorporated herein in its entirety. <br /> <br />3. Air Quality Impact AIR-C: The project could result in a cumulatively considerable <br />contribution to a cumulatively significant air quality impact. <br /> <br />Mitigation Measures. EIR Mitigation Measure AIR-1.1 will be implemented <br />for the Project as provided in the MMRP. <br /> <br />Findings Regarding Impact AIR-1. The City Council finds that incorporating <br />the requirements of Mitigation Measure AIR-1.1 into the Project would substantially <br />lessen the severity of Impact AIR-C, such that this impact would be less than <br />significant, because Mitigation Measure AIR-1.1 requires the project applicant to <br />submit a construction operations plan to the Director of Community Development & <br />Transportation or the Director’s designee that includes specifications of the equipment <br />to be used during construction. The plan shall be accompanied by a letter signed by an <br />air quality specialist, verifying that the equipment included in the plan meets certain <br />standards. With implementation of Mitigation Measure MM AIR-1.1, the cancer risk <br />and annual PM2.5 concentration would be reduced to below the BAAQMD single- <br />source threshold. This finding is based on the entire record of proceedings for the <br />Project, including but not limited to the discussion and analysis set forth on pages 32 <br />through 45 of the DEIR, which includes a full statement of the impact and applicable <br />mitigation measures and is hereby incorporated herein in its entirety. <br />1. Biological Resources Impact BIO-1: Construction activities could impact common <br />native nesting birds and special-status birds such as Alameda Song Sparrow and White- <br />Tailed Kite. <br /> <br />Mitigation Measures. Mitigation Measures BIO-1.1 will be implemented for <br />the Project as provided in the MMRP. <br /> <br /> <br />Findings Regarding Impact BIO-1. The City Council hereby finds that <br />incorporating the requirements of Mitigation Measure BIO-1.1 into the Project would <br />substantially lessen the severity of Impact BIO-1, such that this potential impact would <br />be less than significant, because this measure will require a nesting bird survey if work <br />cannot be scheduled to occur outside of the nesting season, and if project construction
