If no active <br />nests are identified during the surveys, no impacts will occur to birds and work shall <br />progress without restriction. If active nests are identified, a no-disturbance buffer <br />around the nest shall be implemented to avoid impacts to nesting birds. Buffers shall be <br />determined by a qualified biologist. After an active nest is determined to no longer be <br />active, the buffer around the nest shall be removed and work shall progress without <br />restriction. This finding is based on the entire record of proceedings for the Project, <br />including but not limited to the discussion and analysis set forth on pages 46 through 77 <br />of the DEIR, which includes a full statement of the impact and applicable mitigation <br />measures and is hereby incorporated herein in its entirety. <br /> <br />2. Biological Resources Impact BIO-2: Artificial lighting could have a potentially <br />significant impact on local wildlife populations due to the high ecological value of these <br />adjacent habitat areas and the rarity of some of the species inhabiting these areas. <br /> <br />Mitigation Measures. Mitigation Measures BIO-2.1 through BIO-2.3 will be <br />implemented for the Project as provided in the MMRP. <br /> <br />Findings Regarding Impact BIO-2. The City Council hereby finds that <br />incorporating the requirements of Mitigation Measures BIO-2.1 through BIO-2.3 into the <br />Project would substantially lessen the severity of Impact BIO-2, such that this potential <br />impact would be less than significant, because these measures will require shielding <br />exterior lights, orienting lights downward and inward, and minimizing exterior lighting. <br />This finding is based on the entire record of proceedings for the Project, including but <br />not limited to the discussion and analysis set forth on pages 46 through 77 of the DEIR, <br />which includes a full statement of the impact and applicable mitigation measures and <br />is hereby incorporated herein in its entirety. <br /> <br />3. Biological Resources Impact BIO-3: Project activities may result in the injury or <br />mortality of salt marsh harvest mice and salt marsh wandering shrews. <br /> <br />Mitigation Measures. Mitigation Measures BIO-3.1 through BIO-3.4 will be <br />implemented for the Project as provided in the MMRP. <br /> <br />Findings Regarding Impact BIO-3.
