BAYSHORE – EXHIBIT A <br />REV: 05-12-23 JB <br />Page 22 of 30 <br />sequence that was followed to construct a cap over the soil, and a Cap Maintenance <br />Plan to ensure the cap integrity is maintained throughout the life of the development. <br />This finding is based on the entire record of proceedings for the Project, including but <br />not limited to the discussion and analysis set forth on pages 111 through 139 of the <br />DEIR, which includes a full statement of the impact and applicable mitigation measures <br />and is hereby incorporated herein in its entirety. <br /> <br />4. Transportation and Traffic Impacts TRN-1: The project would conflict with <br />adopted plans for bicycle lanes on E. Bayshore Road. <br /> <br />Mitigation Measures. Mitigation Measure TRN-1.1 will be implemented for <br />the Project as provided in the MMRP. <br /> <br />Findings Regarding Impact TRN-1. The City Council hereby finds that <br />incorporating the requirements of Mitigation Measure TRN-1.1 into the Project would <br />sufficiently reduce Impact TRN-1 such that these potential impacts would be less than <br />significant, because this mitigation measure requires on-street improvements along the <br />project frontage to incorporate the planned bicycle lanes on E. Bayshore Road. This <br />finding is based on the entire record of proceedings for the Project, including but not <br />limited to the discussion and analysis set forth on pages 184 through 197 of the DEIR, <br />which includes a full statement of the impact and applicable mitigation measures and is <br />hereby incorporated herein in its entirety. <br /> <br />5. Transportation and Traffic Impacts TRN-2: The project generated home-based <br />VMT per capita is 13.4, which is greater than the threshold of 10.5 for residential <br />uses. Without measures to reduce VMT, the project would have a significant impact <br />based on the project generated VMT. <br /> <br />Mitigation Measures. Mitigation Measure TRN-2.1 will be implemented for <br />the Project as provided in the MMRP. <br /> <br />Findings Regarding Impact TRN-2. The City Council hereby finds that <br />incorporating the requirements of Mitigation Measure TRN-2.1 into the Project would <br />sufficiently reduce Impact TRN-2 such that these potential impacts would be less than <br />significant, because this mitigation measure requires the development of a TDM plan <br />to demonstrate that VMT associated with the project is reduced to a level less than or <br />equal to 10.5 miles per capita. The TDM plan shall be submitted to and approved by <br />the Community Development and Transportation Department and monitored annually <br />to gauge its effectiveness in meeting the required VMT reduction. This finding is based <br />on the entire record of proceedings for the Project, including but not limited to the <br />discussion and analysis set forth on pages 184 through 197 of the DEIR, which includes <br />a full statement of the impact and applicable mitigation measures and is hereby <br />incorporated herein in its entirety. <br /> <br />6. Transportation and Traffic Impacts TRN-C: The project would not result in a <br />cumulatively considerable contribution to a significant transportation impact. <br />
