General Findings and Overview <br /> <br />Record of Proceedings and Custodian of Record <br /> <br />For purposes of CEQA and these Findings, the record of proceedings consists of the <br />following documents and testimony, at a minimum: <br /> <br />• The EIR, which consists of the 505 E. Bayshore Road Project Draft <br />Environmental Impact Report (State Clearinghouse No. 2021080447), dated September <br />2022 and published and circulated for public review and comment by the City from <br />September 23, 2022, through November 7, 2022 (the DEIR), and the 505 East Bayshore Road <br />Project Final Environmental Impact Report, published and made available for public review <br />on April 21, 2023, the FEIR), and all appendices, reports, documents, studies, memoranda, <br />maps, testimony, and other materials related thereto; <br /> <br />• All public notices issued by the City in connection with the Project and the <br />preparation of the DEIR and the FEIR, including but not limited to public notices for <br />all public workshops and scoping sessions held to seek public comments and input <br />on the Project; <br /> <br /> <br />• All written and oral communications submitted by agencies or interested <br />members of the general public during and immediately after the public review periods <br />for the DEIR and DEIR, including oral communications made at public hearings or <br />meetings held for the Project; <br /> <br /> <br />• All minutes, testimony, statements, comments and other materials memorializing, <br />describing or relating to workshops, meetings, scoping sessions, and hearings <br />conducted by the City’s City Council, Planning Commission, Architectural Advisory <br />Committee, and all other departments of the City relating to the City’s review and <br />consideration of the Project; <br /> <br /> <br />• All other public reports, studies, documents, memoranda, maps, or <br />other materials reviewed and/or considered by the City in connection with its review <br />and consideration of the proposed Project, the DEIR, the FEIR, and the MMRP, <br />whether prepared by the City, its consultants, or by third parties; <br /> <br /> <br />• All matters of common knowledge to the members of the City’s Planning <br />Commission and City Council, including but not limited to: (i) the City’s 2010 <br />General Plan, zoning ordinance, and other applicable policies and ordinances; (ii) <br />information regarding the City’s fiscal status and economic and development patterns <br />and trends; (iii) federal, state and local laws, regulations, guidelines and publications <br />applicable to or affecting the Project; and (iv) reports, projections, documents and <br />other materials regarding statewide, regional, and local planning and development
