<br />"Retail Customers" means any customer that purchases water from San Francisc,o that is not <br /> <br /> <br />a Wholesale Customer, whether located inside or outside of San Francisco. <br /> <br />"Retail Service Area" means the areas where SFPUC sells water to Retail Customers. <br /> <br />"Retail Water" means water sold by the SFPUC to its Retail Customers within and outside San <br />Francisco. <br /> <br />"San Francisco" refers to the City and County of San Francisco. <br /> <br />"SFPUC" refers to the San Francisco Public Utilities Commission as an operating department <br />of San Francisco, the General Manager of which reports to the Commission. <br /> <br />"SFPUC Bureaus" refers to the portions of the SFPUC that provide support services to the <br />SFPUC Operating Departments. These presently consist of the General Manager's Office, <br />Business Services, and External Affairs. <br /> <br />"SFPUC Operating Departments" refers to the Water, Hetch Hetchy and Wastewater Program <br />Enterprises under the control and management of the SFPUC pursuant to the San Francisco <br />Charter. <br /> <br />"Substantially Expended": A bon.d issue series is substantially expended when 98% of the <br />proceeds and investment earnings contributed to the project fund have been expended. <br /> <br />"Supply Assurance" means the 184 MGD maximum annual average metered supply of water <br />dedicated by San Francisco to public use in the Wholesale Service Area (not including San <br />Jose and Santa Clara) in the 1984 Agreement and Section 3.01 of this Agreement. <br /> <br />"Term" means the 25-year term commencing July 1, 2009, including one or both 5-year <br />extensions authorized by Section 2.02.A and B. <br /> <br />"Tier 1 Shortage Plan" refers to the Water Shortage Allocation Plan (Attachment H) adopted <br />by the SFPUC and the Wholesale Customers in conjunction with thi,s Agreement describing the <br />method for allocating water between the SFPUC and the Wholesale Customers collectively for <br />shortages of up to 20% of deliveries from the Regional Water System, as amended from time- <br />to-time. <br /> <br />Attachment A, Page 6 <br /> <br />1840795.8 <br />
