Except as provided in subsection C, this Agreement shall become effective only <br />when it has been approved by' San Francisco and by each of the entities listed in Section 1.02 <br />and when San Francisco and each of those entities (except for the City of Hayward) have <br />entered into an Individual Water Sales Contract as provided in Section 9.01. <br /> <br />B. If San Francisco and all of the entities listed in Section 1.02 approve this <br />Agreement and (except for the City of Haywar~) an Individual Water Sales Contract onor before <br />July 1, 2009, the effective date shall be July 1, 2009. If San Francisco and all of the entities <br />listed in Section 1.02 approve this Agreement and (except for the City of Hayward) an Individual <br /> <br />\ <br /> <br />Water Sales Contract after July 1, 2009 but on or before September 1, 2009, the effective date <br />shall be the date on which the last entity listed in Section 1.02 approves this Agreement and, if <br />required, an Individual Water Sales Contract. <br /> <br />C. If by September 1, 2009 this Agreement has been approved by fewer than all of <br />the entities listed in Section 1.02 or fewer than all of such entities (other than the City of <br />Hayward) have entered into an Individual Water Sales Contract, but it has been approved by <br />entities representing at least 75% in number and 750/0 of the water purchased from SFPUC by <br /> <br />-2- <br /> <br />1840795.8 <br />
