<br />D. Notwithstanding the reservation of claims contained in Sections 3.02.C and 8.07, <br />it shall be the responsibility of each Wholesale Customer to limit its purchases of water from <br />San Francisco so as to remain within its Individual Supply Guarantee. San Francisco shall not <br />be liable to any Wholesale Customer or be obligated to supply more water to any Wholesale <br />Customer individually or to the Wholesale Customers collectively than the amount to which it or <br />they are otherwise entitled under this Agreement due to the l,lse by any Wholesale Customer of <br />more water than the amount to which it is entitled under this Agreement. <br /> <br />E. San Francisco shall install such new connections between the Regional Water <br />System and the distribution system of any Wholesale Customer that are necessary to deliver <br />the quantities of water to which the Wholesale Customer is entitled under this Agreement. San <br />Francisco shall have the right to determine the location of such connections, in light of the need <br />to maintain the structural integrity of the Regional Water System and, where applicable, the <br />need to limit peaking directly off of Regional Water System pipelines by a Wholesale Customer's <br />individual retail customers, the need to ensure that a Wholesale Customer's individual retail <br />customers have access to alternative sources of water in the event of a reduction in San <br />Francisco's ~bility to provide them with water, and other factors which may affect the desirability <br />or undesirability of a particular location. San Francisco's decisions regarding the location of <br />new connections and the location, size and type of any new meters shall not be reviewable by a <br />court except for an abuse of discretion or failure to provide a Wholesa'le Customer with <br />connections and meters adequate to deliver the quantity of water to which it is entitled under <br />this Agreement. <br /> <br />3.03 Wholesale Customer Service Areas <br />A. Each of the Individual Water Sales Contracts described in Section 9.01 will <br />contain, as an exhibit, a map of the Wholesale Customer's service area. A Wholesale <br />Customer may not deliver water furnished to it by San Francisco outside the boundary of its <br />service area without the prior written consent of San Francisco, except for deliveries to another <br />Wholesale Customer on an emergency and temporary basis pursuant to Section 3.07.B. <br /> <br />B. If a Wholesale Customer wishes to expand its service area, it shall request San <br />Francisco's consent to the expansion and provide information reasonably requested by San <br />Francisco about the amount of water projected to be purchased from San Francisco to meet <br />demand within the area proposed to be added to the service area. <br /> <br />-10- <br /> <br />1840795.8 <br />
