<br />Article 4. Implementation of Interim Supply Limitation. <br /> <br />4.01 Interim Supply Limitation Imposed by SFPUC <br />In adopting the WSIP in Res. No. 08-0200, the Commission included full implementation <br />of all proposed WSIP capital improvement projects to achieve level of seNice goals relating to <br />public health, seismic safety, and delivery reliability, but decided to adopt a water supply <br />element that includes the Interim Supply Limitation. This article describes how the parties will <br />implement the Interim Supply Limitation imposed by the SFPUC between the Effective Date and <br />December 31., 2018. <br /> <br />4.02 Retail and Wholesale Customer Allocations Under Interim Supply Limitation <br />The Interim Supply Limitation is allocated as follows between Retail and Wholesale <br />Customers: <br /> <br />Retail Customers' allocation: <br />Wholesale Customers' allocation: <br /> <br />81 MGD <br />184 MG D <br /> <br />The Wholesale Customers' collective allocatio~ of 184 MGD under the Interim Supply <br />Limitation includes the demand of the cities of San Jose and Santa Clara, whose demand is not <br />included in the Supply Assurance, as provided in Section 3.02.B. By December 31st, 2010, the <br />Commission will establish each Wholesale Customer's Interim Supply Allocation at a public <br />meeting. <br /> <br />4.03 Transfers of Interim Supply Allocations <br />A. Any Wholesale Customer, including Hayward, may transfer a portion of its <br />Interim Supply Allocation to one or more other Wholesale Customers, as provided in this <br />section. All Wholesale Customers are also eligible transferees, including California Water <br />Service Company up to its Individual Supply Guarantee. <br /> <br />B. Transfers of a portion of an Interim Supply Allocation must be prospective. The <br />duration of a transfer cannot be less than the balance of the fiscal year. The minimum quantity <br />that may be transferred is 1/1 Oth of a MGD. <br /> <br />C. Transfers of portions of Interim Supply Allocations are subject to approval by the <br />SFPUC. SFPUC review is limited to determining (1) whether a proposed transfer complies with <br /> <br />-27- <br /> <br />1840795.8 <br />
