<br />the Act, and (2) whether the affected facilities in the Regional Water System have sufficient <br />capacity to accommodate delivery of the increased amount of water to the proposed transferee. <br /> <br />D. The participants in a proposed transfer sh'all provide notice to the SFPUC <br />specifying the amount of the Interim Supply Allocation proposed to be transferred and the <br />proposed effective date of the transfer, which shall not be less than 60 days after the notice is <br />submitted to the SFPUC. The SFPUC may require additional information reasonably necessary <br />to evaluate the operational impacts of the transfer. The SFPUC will not unreasonably withhold <br />or delay its approval; if the SFPUC does not act on the notice within 60 days, the transfer will be <br />deemed to have been approved. <br /> <br />E. Within 30 days after the transfer has become effective, both the transferor and <br />the transferee will provide written notice to the SFPUC and BAWSCA. <br /> <br />F. Transfers of Interim Supply Allocations shall continue in effect until the earlier of <br />(1) delivery of written notice to the SFPUC by the transfer participants that the transfer has been <br />rescinded or (2) December 31, 2018. <br /> <br />4.04 Environmental Enhancement SurcharQe <br /> <br />A. Establishment of Environmental Enhancement SurcharQe. Beginning with <br />wholesale water rates for fiscal year 2011-2012, and continuing for the duration of the Interim <br />Supply Limitation, the Commission will establish the Environmental Enhancement Surcharge <br />concurrently with the budget-coordinated rate process set forth in Article 6 of this Agreement. <br />The monetary amount of the Environmental Enhancement Surcharge per volume of water, such <br />as dollars per acre-foot, will be equivalentfor Retail Customer use in excess of 81 MGD and <br />Wholesale Customer use in excess of 184 MGD. The Environmental Enhancement Surcharge <br />will be simple to calculate so that Wholesale Customers can estimate potential surcharges for. <br />budgeting purposes and establish retail rates within their service areas. <br /> <br />B. Application of Environmental Enhancement SurcharQe. Beginning in fiscal <br />year 2011-12, the Environmental Enhancement Surcharge will be levied only if and when <br />combined Retail Customer and Whol~sale Customer purchases exceed the Interim Supply <br />Limitation of 265 MGD and if the fund described in subsection D below has been established by <br />the San Francisco Board of Supervisors.
