<br />C. Each Wholesale Customer is a member of BAWSCA. San Francisco shall send <br />a copy of each notice or other document which it is required to send to all Wholesale Customers <br />to BAWSCA addressed as follows: <br /> <br />General Manager/CEO <br />Bay Area Water Supply and Conservation Agency <br />155 Bovet Road, Suite 302 <br />San Mateo, CA 94402 <br /> <br />The failure of San Francisco to send a copy of such notices or documents to BAWSCA <br />shall not invalidate any rate set or other action taken by San Francisco. <br /> <br />D. Any party (or BAWSCA) may change the address to which ~otice is to be sent to <br />it under this Agreement by notice to San Francisco (in the case of a change desired by a <br />Wholesale Customer or BAWSCA ) and to the Wholesale Customer and BAWSCA (in the case <br />of a change desired by San Francisco). <br /> <br />The requirements for notice set forth in Section 8.01 concerning arbitration shall prevail <br />over this section, when they are applicable. <br /> <br />8.10 Incorporation of Attachments <br />Attachments A through Q, referred to herein, are incorporated in and made a part of this <br />Agreement. <br /> <br />8.11 Interpretation <br />In interpreting this Agreement, or any provision thereof, it shall be deemed to have been <br />drafted by all signatories, and no presumption pursuant to Civil Code Section 1654 may be <br />invoked to determine the Agreement's meaning. The marginal headings and titles to the . <br />sections and paragraphs of this Agreement are not a part of this Agreement and shall have no <br />effect upon the construction or interpretation of any part hereof. <br /> <br />8.12 Actions and Approvals by San Francisco <br />Whenever action or approval by San Francisco is required or contemplated by this <br />Agreement, authority to act or approve shall be exercised by the Commission, except if such <br />action is required by law to be taken, or approval required to be given, by the San Francisco <br />Board of Supervisors. The Commission may delegate authority to the General Manager in <br /> <br />-81- <br /> <br />1840795.8 <br />
