<br />8.08 Prohibition of Assi~nment <br />A. This Agreement shall be binding on, and shall inure to the benefit of, the parties <br />and their respective successors and permitted assigns. Each Wholesale Customer agrees that <br />it will not transfer or assign any rights or privileges under this Agreement, either in whole or in <br />part, or make any transfer of all or any part of its water system or allow the use thereof in any <br />manner whereby any provision of this Agreement will not continue to be binding on it, its <br />assignee or transferee, or such user of the system. Any assignment or transfer in violation of <br />this covenant, and any assignment or transfer that would result in the supply of water in violation <br />of the Act, shall be void. <br /> <br />B. Nothing in this section shall prevent any Wholesale Customer (except the <br />California Water Service Company and Stanford) frofl! entering into a joint powers agreement or <br />a municipal or multi-party water district with any other Wholesale Customer (except the two <br />listed above) to exercise the rights and obligations granted to and imposed upon the Wholesale <br />Customers hereunder,. nor shall this section prevent any Wholesale Customer (except the two <br />listed above) from succeeding to the rights and obligations of another Wholesale Customer <br />hereunder as long as the Wholesale Service Area served by the Wholesale Customers involved <br />in the succession is not thereby enlarged. <br /> <br />8.09 Notices <br />A. All notices and other documents that San Francisco is required or permitted to <br />send to the Wholesale Customers under this Agreement shall be sent to each and all of the <br />Wholesale Customers by'United States mail, first class postage prepaid, addressed to each <br />Wholesale Customer at the address to which monthly water bills are mailed by the Water <br />Enterprise. <br /> <br />B..
