REV: 04-07-2023 MI <br />AGREEMENT WITH THE COUNTY OF SANTA CLARA <br />FOR USE OF THE REGIONAL FIREARMS TRAINING FACILITY <br />PARTIES: <br />The parties to this Agreement are the County of Santa Clara, California (“County”) and the City of <br />Redwood City (“Redwood City”) and collectively (“the Parties”). <br />PURPOSE: <br />To enter into an agreement under which County will allow Redwood City, in exchange for certain <br />consideration, to access and use only for training, competition, or other pre-approved purposes the <br />County Sheriff’s Office Firearms Training Facility (the “Range”) and property, or certain designated <br />areas at the facility and property, located at 9600 Malech Road, San Jose, California 95138. <br />TERMS AND CONDITIONS: <br />1) County agrees to allow Redwood City to utilize the Range and property for training or other <br />authorized purposes. <br />a) Redwood City is prohibited from using the Range to subcontract to any other entities, including <br />other agencies, individuals, training providers, police schools or law enforcement academies <br />under any circumstance. <br />b) Redwood City is prohibited from using the Range as part of a fundraising, client appreciation <br />activity or social/entertainment venue. <br />2) Subject to the time limitations in paragraph 5, below, Redwood City shall have access to and use <br />of the Range and property as designated in the fee and usage schedule attached to this Agreement <br />as Exhibit A solely in order to conduct training for regular and specialized firearms, special <br />weapons and tactics (SWAT), and other related training activities for the active, reserve, and retired <br />peace officers of Redwood City. All such training conducted by Redwood City shall at all times <br />be under the direction, control and supervision of authorized and State certified Redwood City <br />firearms instructors. <br />3) The County Sheriff’s Office shall retain the right to use or rent all portions of the Range and <br />facilities that are not rented to Redwood City pursuant to this Agreement, provided that such <br />simultaneous use or rental shall not interfere with the ability of Redwood City to use the portion <br />of the Range and property that it has rented. <br />4) The Santa Clara County Sheriff’s Office Regional Firearms Training Facility is made available to <br />Redwood City for active, reserve, and retired peace officer training only.
