REV: 04-07-2023 MI <br /> <br />allow, escort or train any civilian or non-sworn employees on to the property. Any violation of <br />this clause may result in an immediate termination of this Agreement. <br /> <br /> <br />5) Redwood City shall, for a period of three years commencing upon the execution of this Agreement <br />by all parties, have immediate and continued access to that portion of the Range and property <br />designated by this Agreement. Scheduled use is to be arranged through and is subject to approval <br />of the County Sheriff’s Office. All such Redwood City access and usage shall be limited as further <br />described in this Agreement. Redwood City shall not use the Range and property (including <br />equipment, instruments, supplies or personnel) for any purpose other than the performance of <br />Redwood City’s rights and obligations under this Agreement. <br /> <br />6) Redwood City cannot use the range on weekends or County holidays. On all authorized days, <br />range use must cease by 1800 hours. <br /> <br />7) The County Sheriff’s Office reserves the right to refuse rental and to remove Redwood City from <br />the Range and property if the County Sheriff’s Office firearms range staff determines that <br />Redwood City’s conduct or activity is inappropriate, dangerous, or unsafe. The County Sheriff’s <br />Office also reserves the right to cancel, refuse rental or otherwise amend a scheduled rental request <br />for use of the Range based on Redwood City’s intended use of the facility. <br /> <br />8) Should the County decide to sell the property that is the subject of this Agreement during the term <br />of the Agreement, the County shall reimburse Redwood City that portion of the payment described <br />in paragraph 12 below that Redwood City has paid to the County, on a pro rata basis for the <br />remainder of the unused term of the Agreement. If only a part of the property is sold, that pro rata <br />reimbursement shall be limited to the same percentage as the portion of property sold. <br /> <br />9) If Redwood City elects to terminate this Agreement for cause prior to the expiration of the term of <br />the Agreement, Redwood City may be entitled to reimbursement of a portion of the payment <br />described in paragraph 12, below. <br /> <br />10) Redwood City shall be responsible for and use reasonable care to maintain the Range and property <br />in a reasonable and satisfactory condition during the time Redwood City is utilizing the property <br />with the exception of reasonable wear and tear. Redwood City shall reimburse the County for any <br />misuse and/or negligent use of the premises by Redwood City and its personnel, as reasonably <br />assessed by the County. Overall routine maintenance for the Range and property is the <br />responsibility of the County. <br /> <br />11) Redwood City agrees to comply with the insurance requirements set forth by the County Insurance <br />Manager in Exhibit B-2, attached to this Agreement and incorporated by reference.
