REV: 02-27-24 LF <br />MEMORANDUM OF UNDERSTANDING <br />BETWEEN THE CITY OF REDWOOD CITY AND THE COUNTY OF SAN <br />MATEO TO SUPPORT REDWOOD CITY’S EDIBLE FOOD RECOVERY PROGRAM <br />THIS MEMORANDUM OF UNDERSTANDING (MOU), entered into this ______ day <br />of ____________________ 2024, by and between the County of San Mateo, hereinafter called <br />“the County” and the City of Redwood City, hereinafter called “the City”. <br />W I T N E S S E T H: <br />WHEREAS, the County and the City are implementing the mandates of the California <br />Code of Regulations, Title 14, Division 7, Chapter 12 Short-Lived Climate Pollutants (SB 1383); <br />and <br />WHEREAS, SB 1383 mandates that the County and City both establish an edible food <br />recovery program that mandates that large, food-generating businesses and organizations arrange <br />for the maximum amount of their surplus edible food be recovered for human consumption; <br />educate, inspect, and enforce requirements for regulated businesses and organizations for edible <br />food recovery compliance; and expand the capacity of food recovery organizations to recover and <br />distribute all the surplus edible food available for recovery from regulated businesses and <br />organizations within the jurisdictions; and <br />WHEREAS, on December 1, 2021, the County and City entered into a MOU to establish <br />an edible food recovery program consistent with SB 1383 in the City, which is led and managed <br />by the County. Under this MOU, the County agrees to educate and inspect regulated businesses <br />and organizations and build edible food recovery capacity within the City; and <br />WHEREAS, since January 28, 2020, the County has contracted with a food recovery <br />organization serving the City’s businesses and residents called Nuestra Casa of East Palo Alto to <br />expand the organization’s edible food recovery and distribution capacity within the City (Exhibit <br />A). Through this contract, the County has provided Nuestra Casa of East Palo Alto with funding <br />to purchase refrigerated vehicles, hire drivers and admin staff, pick up surplus edible food from <br />grocery stores and wholesalers, and distribute collected food to community members in need; and <br />WHEREAS, the City has received grant funding from the California Department of <br />Resources Recycling and Recovery (CalRecycle) under the SB 1383 Local Assistance Grant <br />Program to pay for eligible SB 1383 implementation expenses including edible food recovery <br />program development; and <br />WHEREAS, the City has a surplus of up to $30,000 of SB 1383 Local Assistance Grant <br />Program grant funding that must be spent by the end of the grant term, May 2, 2024, or else be <br />returned to the State, and is willing to provide these funds to the County for their edible food <br />recovery program work in the City; and <br />ATTY/AGR.2024.021/San Mateo County (Edible Food Recovery MOU) (Page 1 of 32) <br />April <br />5th
