real property which might suffer legal damage by reason of establishment of the proposed <br />pedestrian malls. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY, <br />CALIFORNIA, HEREBY RESOLVES THAT: <br />SECTION 1. The City Council finds that above recitals are accurate, constitute findings <br />in this matter, and are hereby incorporated into this reference. <br />SECTION 2. The City Council finds that: <br />a. The City Council has reviewed the DTPP SEIR and has considered the <br />information therein, prior to acting upon or approving the pedestrian mall. <br />b. Based on substantial evidence in the record, the pedestrian mall is within <br />the scope of impacts previously analyzed in the Downtown Precise Plan <br />Subsequent Environmental Impact Report ("DTPP SEIR"). The mitigation <br />measures and Statement of Overriding Considerations associated with <br />certification of the EIR address the any potential environmental effects. All <br />applicable mitigation measures and the Statement of Overriding Considerations <br />are hereby reconfirmed and readopted. <br />C. As set forth in CEQA Guidelines sections 15162 (Subsequent EIRs and <br />Negative Declarations) and 15163 (Supplement to an EIR), the pedestrian mall will <br />not result in any new environmental effects, or a substantial increase in the severity <br />of any environmental impact, or require new mitigation measures beyond those <br />identified in the DTPP SEIR. <br />d. In addition, the pedestrian mall is exempt from CEQA pursuant to CEQA <br />Guidelines section 15301. The proposed pedestrian mall would involve <br />improvements on existing highways and streets with negligible or no expansion of <br />use and the addition of protective exclusive pedestrian space, pedestrian crossing, <br />street trees and other similar alterations Accordingly, these improvements are <br />categorically exempt from CEQA under CEQA Guidelines section 15301, which <br />exempts projects that consist of improvements to existing highways and streets <br />with negligible or no expansion of use. <br />SECTION 3. The City Council determines that the public interest and convenience <br />require the establishment of a pedestrian mall, and that vehicular traffic will not be unduly <br />inconvenienced. <br />SECTION 4. Pursuant to the Pedestrian Mall Law of 1960 (California Streets and <br />Highways Code Section 11000 et seq.), the City Council declares its intention to establish <br />a pedestrian mall. The pedestrian mall will be located on two street segments of the 2000 <br />block of Broadway.
