Downtown TDM – Prior to issuance of a certificate of building occupancy, the applicant shall submit for review and approval a final transportat ion demand management (TDM) program which outlines program elements to be implemented. The program shall include an annual reporting requirement, due on December 1st of each year for the first three years, detailing parking utilization rates and tenant use and awareness of TDM programs. The project shall collect (utilizing sensors, loop detectors, or equivalent technology) and make publicly available, real-time garage occupancy data (via a parking app or other means deemed appropriate by the City.) Shared Parking Covenant – The Owner shall submit an executed original Shared Parking Covenant to the City in a form acceptable to the Community Development Director and the City Attorney, providing the City with assurance that the shared parking obligations under the Downtown Precise Plan with respect to the project will be met and that the entire garage would be valet parked and provided to tenants and visitors of the building, for the life of the project in order to avoid potential conflicts between self-parkers and valet parking, during the hours of 7AM - 5PM Monday through Friday. The shared-parking covenant shall be recorded against the property prior to permit issuance. [COA][PLANNING] <br />88. Valet Parking – The entire two levels of the parking garage (B1 & B2) shall be valet parked for visitors, and patrons of the office building and retail establishments during the hours of 7AM to 5PM Monday through Friday with the exception of holidays. [COA][PLANNING] <br /> <br />89. Valet Parking Stand – The valet parking stand shall be located on the first level (B1) of the parking garage, at the end of the east side drive isle. [COA][PLANNING] <br />90. Removal of Valet Parking – The proposed five valet parking spaces located on the first level (B1), in the east side drive aisle lane are prohibited for cars to be park. Thus, at the time of building permit submittal, the applicant shall submit a parking layout of the garage with the five relocated valet parking spaces within the garage. [COA][PLANNING] <br />91. Valet Parking Operation – The valet parking staff shall re-park vehicles located in the drive aisle to park parking stalls, once available parking stalls become available. [COA][PLANNING] <br />92. Parking for Retail Patrons – Daytime retail patrons of 2075 Broadway shall be allowed to use the on-site parking. The valet service shall allow visitors and patrons of the proposed retail establishments on-site to park during the daytime hours (7AM – 5PM) Monday through Friday with the exception of holidays, and discourage non -retail patrons and workers of the building to not park in the garage. [COA][PLANNING] <br />93. Notice of Right – The applicant shall submit a “Notice of Right to Downtown Operations” to all tenants prior to execution of any lease per Section 2.2.6 of the DTPP. [COA][PLANNING] <br />94. Noise and Vibration – The applicant shall incorporate the following within the construction drawings per the site-specific noise study: [SDR][PLANNING] <br />a. All building facades (exterior windows and doors) shall be sound-rated between 28 and 39 STC (Sound Transmission Class), as diagrammed in the noise report.
