ATTY/RESO.0118/PC RESO SOUTH MAIN MIXED-USED PROJECT
REV: 10-21-2020 PR
generators are installed or permitted. This finding is based on the entire record of
proceedings for the Project, including but not limited to the discussion and analysis
set forth on pages 3.2-34 through 3.2-38 of the DEIR, which includes a full statement
of the impact and applicable mitigation measures and is hereby incorporated herein
in its entirety.

5. Biological Resources Impact BIO-4a: The project could have a substantial adverse
effect, either directly or through habitat modifications, on any species identified as a
candidate, sensitive, or special-status species in local or regional plans, policies, or
regulations, or by the California Department of Fish and Game or U.S. Fish and Wildlife
Service.

Mitigation Measures. Mitigation Measures BIO-1 and BIO-2 will be
implemented for the Project as provided in the MMRP.

Findings Regarding Impact BIO-4a. The City Council hereby finds that
incorporating the requirements of Mitigation Measures BIO-1 and BIO-2 into the
Project would substantially lessen the severity of Impact BIO-4a, such that this
potential impact would be less than significant, because Mitigation Measure BIO-
1 requires surveys to determine the presence of nesting bird and if active nests are
identified, development of construction-free buffer zones. Mitigation Measure BIO-2
requires preconstruction surveys to determine the presence of roosting bats and if
active bat roosts are identified, development of a suitable buffer or if applicable, a
bat mitigation and exclusion plan to compensate for lost roost. This finding is based
on the entire record of proceedings for the Project, including but not limited to the
discussion and analysis set forth on pages BIO 4.4-2 through BIO 4.4-4 of the Initial
Study, which includes a full statement of the impact and applicable mitigation
measures and is hereby incorporated herein in its entirety.

6. Cultural Resources Impact CR-1: The Project would result in a substantial adverse
change in the significance of a historical resource.

Mitigation Measures. Mitigation Measures CR-1a, CR-1b, CR-1c, CR-1d,
and CR-1e will be implemented for the Project as provided in the MMRP.

Findings Regarding Impact CR-1. The City Council hereby finds that
incorporating the requirements of Mitigation Measures CR-1a, CR-1b, CR-1c, CR-
1d, and CR-1e into the Project would substantially lessen the severity of Impact CR-
1 by limiting the loss of historical information associated with demolition of the
Perry’s Fuel & Feed Shed, however, it would not prevent the loss of a significant
historical resource, and this impact remains significant and unavoidable. The City
Council further finds, however, that development of the Project will provide specific
economic, legal, social, technological and other benefits, including region-wide or
statewide environmental benefits that will outweigh the unavoidable adverse effects
of Impacts CR-1 as set forth in the Statement of Overriding Considerations below.
These findings are based on the entire record of proceedings for the Project,
including but not limited to the discussion and analysis set forth on pages 3.3-19
