ATTY/RESO.0141/PC RESO AMENDING PROPOSED ZONING ORDINANCE CHANGES <br />REV: 12-03-2020 PR <br />Page 9 of 18 <br />for the project corresponding to said zoning in accordance with Article 46 42 of this <br />Ordinance, and if the project meets the following criteria: <br />C. The residential portion of the site satisfies all of the requirements of the "R-5" <br />(Multi-family-High density) Zoning District. as set forth in Article 10 of this Zoning <br />Ordinance. <br /> <br />[Article 31, Sections 31.2 is amended, and Section 31.12 and 31.15 are added, as follows] <br /> <br />Article 31 – SPECIAL USES <br /> <br />31.2 - Assisted Living Facilities. Building Intensity Limits for Residential Care Facilities <br />and Skilled Nursing Facilities <br />Nursing homes; Rest Homes; Residential Care Facilities, Senior; and Skilled Nursing <br />Facilities shall permitted, conditionally permitted, or not permitted consistent with the <br />allowed land uses of the district in which they are proposed to be located. These uses <br />shall be considered commercial for the purposes of determining building intensity, and <br />subject to applicable FAR limits. The maximum number of beds or suites shall not be <br />restricted with residential density maximums. subject to compliance with all dimensional, <br />design, parking, landscaping, and All other development standards of the district shall <br />apply. in which the development would occur, except those standards relating to density <br />or number of units allowed for nonspecialized housing. <br /> <br />31.15 Accessory Outdoor Commercial Uses Reserved <br />A. Purpose. The purpose of this section is to permit accessory, customer-oriented <br />outdoor retail, restaurant, and commercial services on private property while <br />ensuring adequate access, parking, landscaping and maintenance. <br />B. Definition. Accessory outdoor uses are retail, restaurant or other personal <br />customer-oriented services that occur outside an enclosed structure and are <br />incidental to an enclosed primary use on the same site. These uses can include <br />outdoor display of goods, dining, and other provision of commercial services. <br />C. Applicability. These regulations apply to all permitted and conditionally permitted <br />uses in commercial and mixed use zoning districts on private property. Uses in <br />residential and industrial zoning districts are regulated individually in each zoning <br />district. Accessory outdoor uses on public property must receive separate approval <br />with an encroachment permit. Food trucks are not regulated by this section. <br />D. Accessory Outdoor Use Requirements. Accessory outdoor uses are permitted with <br />the following requirements: <br />1. Hours of Operation. Hours of operation for outdoor services shall not <br />exceed the normal hours of operation of the business. <br />2. Outdoor Dining and Bars. Outdoor dining shall be available only for existing <br />restaurants that are current tenants of the shopping center or commercial <br />building.
